While I do understand this logic, the flip side would be if I was really wasted such that I could not reasonably discern that my friend was also impaired and had counted on my friend to be the designated driver. In that case, charges/lawsuits would be justified. If I'm dead, it would be difficult to know which scenario was correct for the prosecutor or my family.
Just a bad scenario all the way around.

What do you do then?
What should the criminal justice system do then?
It's gross negligence and there is a crime for that.
Not to get on a tangent, it's like when someone accidentally shots the person in the woods, instead of the animal. Gross negligence and a crime, but the charges vary.

Also unless the name that I was told and that also appears in the comments is wrong, he is practically erased from the Internet.
That could just be coincidental and he never had much of an Internet presence though. But I kinda doubt it. Real estate agents live for internet presence.
If the public records I'm finding are right, he connected to a doctor in Metairie and an attorney in Metairie. This is just my amateur searching

If that is the case I would expect it to take weeks, though they may know what the results will be already, based on hospital labs. They may also be waiting on the driver to regain consciousness to actually charge him. If he dies, no criminal charges will be filed. Any civil suits are another matter.

I think most on here do not think of chain of custody and admissibility in a Louisiana criminal courtroom. I'm not sure if a hospital blood test is admissible in Louisiana evidence / criminal courts, or if the blood sample has to be ran through a Louisiana crime lab... which could take months.
Sad event either way. Hope lambo has some change saved to retain a damn good criminal defense lawyer.

If the info I'm finding on random arse public records is him, he is married or was married... But it is also a super common name, so who knows? I wouldn't be surprised if there happened to be more than one person from money/power in NOLA with that name.
But then again, if there was more than one, the chances of me finding a social media page or whatever would be more likely. It is clear everything has been wiped.
