I did not know Kristi, but I know her mother. This is just heartbreaking.

A lot of people have told me they know her father. He's in ancient athletes here in BR so lots know him from that.

I'm so sorry for all Kristi's friends and family. I worked with her mom for a long time and met her dad many times over the years. They're such good people. I hate to think of her mom's light and spark diminished.
I also have a 23 year old. As a parent, things like this scare the hell out of me.

Seems reasonable that he would be, If he isn't, that would be a better indication of him being protected. I suspect they could already have charged him but are awaiting toxicology so as not to charge him then have to revise to a higher charge afterwards

I am uncertain as to the specifics of forced blood test of an unconscious suspect but I would bet they can't use a simple hospital blood test. Probably need a court order to start then a controlled chain of custody and finally a test at an approved lab.
If that is the case I would expect it to take weeks, though they may know what the results will be already, based on hospital labs. They may also be waiting on the driver to regain consciousness to actually charge him. If he dies, no criminal charges will be filed. Any civil suits are another matter.
ETA: As genuineLSUtiger said, vehicular homicide will be the charge for this guy if he survives

Any trauma victim brought into the ER has massive blood panels drawn and processed STAT. Doctors treating the patient must know what is already in the person's system. Those lab results are generally available before the patient is transferred to surgery or ICU, except in the case of massive hemorrhage get and other conditions that need immediate surgery.
From experience, I had a relative who was in an accident with her car flipping a few times and herself being ejected out of the back window of the car. She survived with bruises and pulled everything. She was not conscious when taken to the hospital. Blood was drawn and she was found to have multiple substances in her system. These results were immediately given to police and the ticket written included the information. This person was an RN and came very close to losing her license to practice due to this event.
If this can happen to the average joe blow, why not this man?

I think it could, but this is going to be a serious felony charge so there may be other considerations.
As I stated, I do not know what the local/state laws are in NOLA. I do know that getting medical information from a hospital without consent is bordering on breaking certain federal regulations and, in some places, getting any medical data, drawing blood or even getting DNA without consent requires a court order.
So if the driver is wealthy or a member of a wealthy or prominent family, it is probably best to dot all the i's and cross all the t's to avoid evidence being thrown out. They may also be waiting to see if the driver survives before charging him.

I feel weird about drivers being charged when their passenger is the one killed. I have gotten in a car with my friends while drinking before. If we happened to crash, the last thing I would want is my friend to get sued by my family. I willingly made the decision to get in the car. I know the state has to press charges though
