I posted this link in the other thread...but yeah...if what they said is accurate, he's a murderous psycho. They should give him a new trial and give him the death penalty instead of the light sentence he got.

I’ll die laughing if all the race baiting blacks who begged for a retrial end up getting the kid a longer sentence

This actually makes a ton of sense. What happened didn’t seem random or self defense at all. In the video it happens so quick it almost seemed planned. Dude was a ticking time bomb.

Because the prosecution thought they had plenty enough without it. But now they're trying to weasel out of this so here it comes.

I think the term is looking a gift horse in the mouth.

He does. He is not fit for society. And never will be.

I think there was some agreement between the two sides that wouldn't include prior incidents with either kid.
Well this is just making that thug look worse
If he gets a new trial (unlikely). He could get a worse sentence.
Also just gonna leave this here........

Was he granted a new trial? I stay off fb these days, need a break from the bs.
Not decided. They got the original judge removed from new trial decision process because of an interview the judge did afterwards where he was asked if he thought the jury made correct decision. Instead of declining to answer he went into jury was right because they were correctly selected, made decision based only on what was presented in court, and came back with a verdict. It was played out to be more like he was basing answer on facts on the case and his personal opinion on whether Karmelo was guilty especially when he mentioned he thought Karmelo seemed like a good kid who committed a crime and understands now better than before there are consequences for breaking the law.
It was stupid to give that kind of interview so soon.
quote:
Visiting Judge Sid Harle presided today. From Fox News:
Judge John Roach, who presided over Anthony’s June murder trial, was removed after Anthony’s attorneys played Roach’s post-trial WFAA interview in court and argued his remarks showed he had already prejudged the defense’s request for a new trial.
Harle said Wednesday he did not know Roach and described recusal as a high bar. He said he did not find that Roach violated judicial conduct rules and believed Roach could be fair.
But Harle said the question was not whether Roach could be fair. He found that a third party looking at Roach’s public comments could question the judge’s impartiality and granted the recusal motion.
In June, Roach told WFAA:
When asked whether the jury reached the correct verdict, Roach offered a direct response.
“Yes they did because they were picked based upon the law, they listened to the facts, it happened in this courtroom, and they got a verdict,” he said. WFAA ended its interview asking about the judge’s brief interactions with the now-convicted Karmelo Anthony.
“He seems like a nice young man who committed a crime and he understands today more than any day before the consequences of committing a crime like he did,” Roach said.
Roach said he believes Collin County’s handling of the trial should serve as a model for other jurisdictions dealing with high-profile cases.
I guess by 3rd party the visiting Judge is talking about blacks…

It would be funny if they upgraded the charges

This is all coming out because of the motion for a new trial.
If I’m not mistaken, the motion is based on the fact that there were no black people on the jury? That’s not how this works.
Pretty soon, they will be trying to make it illegal to convict a black person of a crime. That sounds silly, but I’m convinced that a significant segment of society would support it.

35 years for that motherfricker wasn’t enough. Whatever evidence this is, they should have used it. They should have given him the death penalty.

Civil rights activists are completely convinced that whites are incapable of being unbaised towards blacks when the reality is blacks have EXTREME in-group bias towards other blacks. It is literally the opposite of what these progressive race hustlers scream per data.

No, doesn't seem random at all when someone voluntarily goes into a stranger's tent, refuses to leave when asked, and then stabs the person in the tent that is confronting them.

It's a motion requesting permission to enter evidence of "other bad acts".
The details given of his “bad acts” seem more pertinent than just examples of bad behavior in the past. They seem to go straight to his state of mind just prior to the knife attack.

What’s a 404 motion?
In Louisiana, a motion regarding La Code of Evidence Article 404(B) puts defense on notice of the State's intent to use certain previous bad acts by the Defendant, regardless of any prosecution or conviction therefore, at trial. They may be used for one or more of certain limited reasons such as lack of accident, motive, identity, etc., but not merely to show that the defendant acted in the current matter in accordance with a prior disposition as previous incidences. In other words, this wasn't Karmelo's first rodeo, and he did not act in sudden heat of passion because he has evidenced the intent toward knife violence before.
quote:
When was it filed: before, during, or after the trial and/or sentencing hearing?
Don't know. Here, it would need to be before trial if introduced for trial purposes. Maybe it's for sentencing purposes in Texas?
quote:
Was this information available and presented at trial?
Presumably available. State may have not felt it necessary to present, or that it could potentially be an issue for appeal so they decided to not give defense that opportunity.

Not possible to upgrade to next up - capital murder. He could get a longer sentence which would extend his time before he attempt to be paroled, but I doubt it would be much longer. He could also get a jury with white female liberals on it or with biased blacks who learned that to be on jury they shouldn’t admit to having any qualms about convicting a brother as that and being teachers were why the blacks in line to be on jury were removed.
Under 18 can still be convicted of capital murder but get life with parol, but the below are requirements to be convicted of capital murder in Texas which don’t fit this murder:
quote:
1) the person murders a peace officer or fireman who is acting in the lawful discharge of an official duty and who the person knows is a peace officer or fireman;
(2) the person intentionally commits the murder in the course of committing or attempting to commit kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat under Section 22.07(a)(1), (3), (4), (5), or (6);
(3) the person commits the murder for remuneration or the promise of remuneration or employs another to commit the murder for remuneration or the promise of remuneration;
(4) the person commits the murder while escaping or attempting to escape from a penal institution;
(5) the person, while incarcerated in a penal institution, murders another:
(A) who is employed in the operation of the penal institution; or
(B) with the intent to establish, maintain, or participate in a combination or in the profits of a combination;
(6) the person:
(A) while incarcerated for an offense under this section or Section 19.02, murders another; or
(B) while serving a sentence of life imprisonment or a term of 99 years for an offense under Section 20.04, 22.021, or 29.03, murders another;
(7) the person murders more than one person:
(A) during the same criminal transaction; or
(B) during different criminal transactions but the murders are committed pursuant to the same scheme or course of conduct;
(8) the person murders an individual under 10 years of age;
(9) the person murders an individual 10 years of age or older but younger than 15 years of age; or
(10) the person murders another person in retaliation for or on account of the service or status of the other person as a judge or justice of the supreme court, the court of criminal appeals, a court of appeals, a district court, a criminal district court, a constitutional county court, a statutory county court, a justice court, or a municipal court.

Good stuff.
His sentence should be extended.

Which is why a motion would be filed to have them admitted.
quote:
(b) Other Crimes, Wrongs, or Acts.
(1) Prohibited Uses. Evidence of any other crime, wrong, or act is not admissible to prove a person’s character in order to show that on a particular occasion the person acted in accordance with the character.
(2) Permitted Uses. This evidence may be admissible for another purpose, such as proving motive, opportunity, intent, preparation, plan, knowledge, identity, absence of mistake, or lack of accident.
(3) Notice in a Criminal Case. In a criminal case, the prosecutor must:
(A) provide reasonable notice of any such evidence that the prosecutor intends to offer at trial, so that the defendant has a fair opportunity to meet it;
(B) articulate in the notice the permitted purpose for which the prosecutor intends to offer the evidence and the reasoning that supports the purpose; and
(C) do so in writing before trial — or in any form during trial if the court, for good cause, excuses lack of pretrial notice.
