Judge overturns teachers conviction for assault kicking chair out from under a student

Kimberley Peschi, 42, of Galloway, was originally found guilty of simple assault after she was accused of pulling a 12-year-old student’s chair backwards at Belhaven Middle School in Linwood in 2017.
The sixth-grader, whom she was supervising during lunch in the cafeteria, had been leaning back in the chair when Peschi kicked the legs out from the chair, causing him to fall and hit his head on the floor.

Looks like she tried to kick the seat of the chair back to level like "sit your arse down."
If she was trying to knock the kid down, I would have kicked the leg.

This became a case??? Whoever blew this up (probably the parents) need to grow some thicker skin. There's a difference between protecting your child from cruelty and keeping them from learning life lessons.

She 100 percent put her foot on the top back of the chair and pulled her leg back causing the fall probably to make a point. Then he hit his head.

This is good. Teachers should be able to do things like this in school when kids aren’t listening. The judge probably feels the same. Intentional but warranted.
