Show me a current statute in ANY US jurisdiction that allows a cop to follow up even a lawful order that is not complied with to commit an assault and battery then walk away. Further what lawful order could a cop be enforcing by slapping away a cell phone? Cop simply lost his shite

The issue you keep overlooking is the cop committed a crime then flipped him off and walked away. There is no legal defense for what the officer did. Whether the kid did something that warrants an arrest prior to the video starting is irrelevant either the cop needs to be charged or both of them.

If you fight like you interpret statutes you are in for your second arse whipping of the evening.

so your only issue is with the first cop? not the one that pulled him over the barricade?

Had to be because without the actions of the first cop does this kid flip them off? Probably not
From everything I’ve seen and gathered here’s what I think happened. Fight broke out. Cops come in and start arresting people. Crowd forms and pulls out phones. Most likely a little back and forth shite talking. This cop knocks this kids phone out of his hand. Flips him off. Then walks away like a little bitch. Kid flips him off back and gets taken down.

That is the one I need zero further information to see a crime was committed. It is possible the ones that took him down and arrested him were making a lawful arrest, I am not judging what I don't have enough facts on. It is clear in the video the first officer committed a crime and further escalated the encounter.

well the entire tone of this thread has been excessive force....slapping a phone out of someones hand isn't excessive force.

It is assault and battery. I think you have misread a LOT of the responses in the thread if you think the main focus of the posters who you disagree with is on excessive force which legally has to be associated with restraint, detention or arrest, none of which the first cop was attempting.

Are you 100% positive of this based solely of a video that clearly left stuff out? You seem to care very much about legal definitions and what not, so I'd think you of all people would appreciate seeing all the evidence before making a snap judgement.

Initial reports said they were responding to a fight.

I'd feel pretty confident saying he wasn't even attempting it considering he completely walked away after flipping the kid off. He wasn't even a part of the takedown.

yep and i don't see a bunch of people getting arrested

Look I was an ADA (not in LA) for 5 years and I am 100% convinced the first cop committed a crime. Just think of it this way, if the cop had punched him instead of slapping his hand do you see how that would be a crime if he simply walked away and was not attempting to detain him? Cops have to abide by the same laws as you and I. We have certain exceptions to battery as do they but none apply here. They also have exceptions when carrying out certain lawful components of their jobs which he was not doing evidenced by the fact he walked away.
From my point of view if a citizen had done that and had a clean record I would have offered pre-trial diversion, for a cop with a clean work record and I could verify with people I trusted in the department that he was "clean" I would drop the charges as long as he was given what I thought was adequate administrative punishment. The guy just snapped at the end of MG, no need to ruin his life but he can't skate either.

I am not a great legal mind so this is just my opinion, for whatever it's worth. If you piss a cop off, and break the law in front of him, you are getting arrested. The first cop was pissed off, almost to the point of being out of control.
If the kid had broken any laws, the first cop would have initiated arrest proceedings. Instead, he assaulted the kid, flipped him off, and walked away. This tells me the kid had broken no laws. When the kid flipped them all off, while screaming "frick all y'all", the other cop saw an opening to arrest the kid, probably on a charge of creating a public nuisance, drunk in public, or some other minor, thin thing.
Once he grabbed the kid, the other officers immediately jumped in because they are going to help their brother, no matter what.
The crowd was yelling that that the cops were wrong, having seen whatever happened from start to finish.
The cops will investigate themselves and find that they did nothing wrong. Charges will get dropped. It remains to be seen if the kid is going to get an attorney.

I don't disagree this first cop likely did something wrong. But I no longer trust initial videos of anything. What is the huge problem with waiting for everything to come out?

What, what did he do? Is flipping off a cop a crime? It’s realy disrespectful but is it against the law?
Cop.flipped him off first. I didnt see them arrest the cop....and thatsbafter the cop initiated contact

I doubt he'll have to look hard for one. Most likely, they'll be lining up for him.

Totally justified.
