I just don't see how you could ever hold a city liable for 3rd party crime.

If the city has legal liability for terrorist acts, then they must have liability for your run of the mill murders as well.

I don’t work for the government. You control what you can control. You saying there would be a new target is the entire point of risk mitigation. If you harden a target you eliminate the risk of that happening in that area.

Why bother protecting the capitol or the national mall? They’ll just attack the national zoo?

I wouldn’t go that far. Teedy made sure to pat herself on the back when she said she went to each victim and made the sign of the cross. That was an odd injection to me. She could tell the families that if she wants. Lots of use of “I” when she talked. She said “I am confident”. That’s not comforting to me. Should have said “we”.

I heard a comment from the FBI agent in charge. He said in passing that the reason they thought there was multiple accomplices was because there was people on video opening the ice chest and walking away. Who the hell opens an ice chest with an IED and doesn’t report it? Even if you don’t know what it is it’s still gotta look fishy.

Let's say it was not a terrorist act but some idiot making an illegal turn over the sidewalk and onto the street before realizing he had done it.

I understand that is far fetched but roll with me.

The city NOW knows that this particular intersection has a previous mass casualty incident in the exact same manner. They elect to not do any of even the most rudimentary preventative measures.

Are you saying the city should have no liability in that scenario?

Let's say it is a terrorist incident.

And someone does it again.

A 3rd person does it. Then a 4th. The city still does nothing.

How are they not willful in this scenario

Bollards don't address the IEDs, so the city would still be on the hook in your interpretation, right?

I seem to remember Bourbon having these yellow concrete post things blocking it from traffic decades ago when I first visited. Am I misremembering another place?

I do know there was a big deal made about installing the last set of fancy automatic barricades, I think it was for the last Super Bowl. I guess those never worked (shocker) and are being replaced now.
