yeah I agree. I'm going to assume that he just wasn't all there in the head and that prevented him from fully maximizing the preparation for this.

Louisiana does not have immunity for personal injury caused by the city, for instance.
This is true. But there is no mechanism to make a city pay a judgement. You know who is famous (infamous) for not paying judgements - New Orleans

There was a cop car blocking the road. What more do you think would have stopped this? The guy hooked at the last minute.
For the present case, nothing.
LNCH is saying they should do nothing further to prevent a future action like this.
My argument is that now that a flaw in security has been exposed, they should at a minimum put up sidewalk bollards. Not doing so could expose them to some level of liability as it would be grossly negligent to do absolutely nothing.

Possibly. Knowing now he places the IEDs wouldn’t he have saw the Manlift and known he would of been blocked in a vehicle?
Also a good question.

I am well aware. I would never take such a case.
I had one case early in my career where the City agreed to pay $1,000.00. They did not pay it for 10 years.

Not installing bollards is totally the same as do nothing. Totally

I don't know how much of the lift was blocking the road but earlier in the thread, someone theorized that maybe his hood flew up from earlier impacts so he couldn't see and hit the lift.
Either way, he wasn't going much further due to construction.

What are you arguing they should do, specifically.

As I recall, protections exclude "gross negligence" as well as willfull, malicious, or intentional acts by city employees.
Unless the city just went full anarchy and disbanded all law enforcement, I can't see any theory of gross negligence being successful.
Also, LA Rev Stat § 9:2798.1 Subsection B states:
quote:
Liability shall not be imposed on public entities or their officers or employees based upon the exercise or performance or the failure to exercise or perform their policymaking or discretionary acts when such acts are within the course and scope of their lawful powers and duties.

I wonder if the hood flew up because of crashing into it or before.
If the hood flew up prior, then he may not have been able to see where it was, even if he knew it was there.

There seems like enough space for the truck to have passed it, but I wouldn't doubt his view was obscured either by the crowd/debris/hood etc

There are 2300+ citing references to that statute, but I already know that "Willful" misconduct is an exception.

Or during the crash the detonators flew around the car and he couldn’t grab them / find them. He was flying down the street Im sure his shite went everywhere.
Also curious where the IEDs were and how viable they were. Maybe he did try to detonate and they failed.
