She got a large which is about the equivalent to 3 cups of coffee. If she didn’t understand that a large size means more caffeine then the regular then that’s on her.

The not so subtle difference is every Snickers ever sold is full of peanuts and you could clearly see them if you bit into a bar. Lemonade while usually filled with an unholy amount of sugar generally does not have caffeine in it.

There are lots of scenarios where the majority of blame would fall on the customer and a lot where the majority of blame would fall on the store/company. One really needs a lot more information in order to apportion blame. How each entity's negligence affects the ultimate outcome of the case depends in large part on the tort laws concerning negligence in the particular state. PA follows a modified 51% comparative negligence rule so if she is found to be less than 51% negligent then her estate can recover the stores percentage of the value of the case.

They sell a regular lemonade. It does not taste anything like the "charged" lemonades.

In store everything is self serve, so there wouldn't be any confusion. Drive thru is the only way possible and they have been charging more for the charged for the last year (might be in response to this.).

Nah. They are just making it clear they are talking about 20 fl oz of drink and drink alone. But most will fill half that volume with ice. So the actuals of filling a 20 oz drink will be less.

They are covering their arse showing worst case scenario.
