No reason at all to be embarrassed. Attorneys get a bad rap for "never wanting to give a straight answer", but the reality is that we generally aren't obfuscating: shite's just usually fricking complicated

Nothing wrong with coming in hot with an opinion, as long as you're willing to reasonably re-examine that opinion once you're presented with more information

Not from what I saw

He was hit and on the ground but looked like the other was just looking at him and continuing the attack.

Felt more like retaliation to me than preventing death or serious bodily harm. Not saying that the aggreasor would not have resumed the attack later but at the time of the shooting he seemed to have pulled back.

I think he was a little to fast to move to deadly force

The guy in the black wasn’t part of the actual fight it doesn’t appear. He hit him because he had a gun

Justified, hit from behind and without context it appears that he was outnumbered. Not sure if all of them were against him but it appears at least it wasn't one on one.

justified in self defense, but still deserves some form of charge.

You don't carry and actively engage in a fist fight, then pull.

If I am carrying, I'm not getting in a physical altercation with someone. I'm talking it down or pulling to prevent a fight.

Outnumbered in and of itself is irrelevant. For example gun guy was the aggressor and blue shirt no gun guy was not 50 people can jump in to defend him and all are protected under the law until they cross a line in the particular jurisdiction which will vary and normally a jury question.

There is also another issue that could be at play but generally unlikely. The "aggressor" can change within an altercation (at least in most jurisdictions). If the aggressor breaks off the attack and moves away in time and distance there is a point (again local law that likely will end up a jury question, technically a trier of fact question since the defendant could request a bench trial) where if the former victim reengages he could then be considered the aggressor for the following actions. This is also reinforced in NY due to the duty to retreat.

That dude was going to straight up shoot someone after getting knocked down. Watched it 15x.

He was then hit from behind. Then he shot the dude

This is a perfect storm of what was just or not.

I’m a conceal carry permit owner and I’m torn on this.
