It would probably be small claims court which you wouldn't actually hire a lawyer for. But actually taking your neighbor to court may not be advisable for simple practical reasons. You still have to live next to this person.

That said, I don't know what I would do. I could understand doing this on accident just being a little thoughtless, but it takes a real a-hole to keep doing something like this after being told that he's damaging property.
