I’m going to be down voted to hell, called fat, etc... but here goes nothing.
Good example. It’s businesses like varsity sports that are going to be (have already been) hit hard.
From the March 22 EO:
Section 4 - In addition to business closed by EO 30 (which was bars, casinos, restaurants), the following shall close:
1) public amusement
2) personal care/grooming
3) malls (Varsity Sports is not a mall)
Section 5: “any business not covered by guidance from the CISA and not ordered closed in Section 4 shall reduce operations to continue with minimal contact and be limited to 10 person operations.
So go to the CISA guidance:
As you scroll through the document, there is no guidance pertaining to small retail shops similar to Varsity Sports.
After reading through all of this, it seems that Varsity Sports could have remained open provided that they adhered to “social distancing” and 10 person operations (no mention of the number of clients within the business).

I see you fail to address the key point of the order that forbids the customers from shopping. And as I noted, they are still “open”.
But it’s not shocking you aren’t understanding/comprehending.

Change the EO to allow customers to shop in “non essential” stores and JBE’s statement, and your position, is accurate.

Here’s your post, which is the post that I originally replied to.
The entire premise of the post is surrounded by the process of determining if a business is allowed to be open, per the EO.
My response was entirely in reference to the legality of a business to be open vs closed.
The situation of “but the customers can’t go there to shop” is an entirely different issue and obviously shows a huge problem with the EO.
But - as I’ve maintained, the ability of a business to be open vs closed has always been clear.

Actually had u read the original order it stated very clearly that it wasn’t just essentials who could be open. My business is not essential and we never closed, not one day. Order named essential businesses and stated which non-essential business MUST CLOSE. If you didn’t fall under the must close category you could stay open, just follow the social distancing guidelines.

Correct. The employees could go to work. Many businesses have been doing this.
The issue is that the customers are not allowed to shop, per the EO.

Yes, I see the issue with the EO as it relates to customers at non-essential business.
Which is why I said earlier that businesses have a hard decision to make with regard to being open vs closed.
But - at the end of the day, there are businesses that could legally remain open if they thought that it was in their best interest to do so.

If you are referring to employees of said business - see Section 3 of the EO which explains that they can go to work.
If you are referring to customers being needed to “run” a business - see previous conversation with Golfer
