If you get pulled over, do you answer seemingly innocuous questions?

Such as:

Where are you coming from?
Where are you headed?

I saw an interesting video recently where a lawyer says the best way to handle this is to say "Officer, here is my license, registration, and proof of insurance. I am going to exercise my right not to answer any of your questions, am I free to go?"

Apparently, police ask these sorts of questions to make up a route in their minds as to where you may have been or be going. There could be bars along the way, they can determine if they think you're BSing them if they think you aren't headed in the proper direction of where you said you were coming from and going. They even read your non-verbal cues, which for anyone just nervous of being pulled over could look like you're lying when you're 100% innocent.

The landmark U.S. Supreme Court case is Rodriguez v. United States (2015). The Court ruled 6–3 that a traffic stop cannot be prolonged—even for a few extra minutes to wait for a drug-sniffing dog—beyond the time needed to handle the initial purpose of the stop, unless there is independent reasonable suspicion of other crimes. So, if you aren't giving them information, they can't even get a sniff of something they're making up in their minds to phish for more information.

Of course, this is from the standpoint you really are innocent and only got pulled over for running a stop sign or going a little over the speed limit.

I have never actually thought of this before, and just randomly this video appeared on my feed one day. If I can find the exact one, I will add it to this topic. Looking at it now, it makes perfect sense.




Personally, I wouldn't see this going over well with a cop.

My 87 yo farmer neighbor starts with "Do you know who the phuck I am?".

He hasn't gotten a ticket in years.

I've never been asked these questions when stopped. They always start with "License and registration and insurance please." And then "I stopped you because _________." That's about it. I've been let off most of the time with just a warning.

I don’t try to be difficult and everyone moves on with their day.

With that said, I haven’t been pulled over since I was a teenager.

Sometimes people do get pulled over for going 5 over.. there are towns or municipalities that have quotas and they don't care how they get them.

I’ve only been pulled over 3-4 times in my life but there was never a conversation. It was license, insurance..I caught you going so and so..he leaves and returns with the ticket and tells be safe.

Speeding, and a rolling stop. Once I spun my tires when the light turned green and rolling out from the cloud behind me was an NOPD cruiser. He pulled me over, laughed when I told him I was sorry and had just bought the car. He gave no ticket and told me "just check who is behind you next time."

If you want to make the encounter less pleasant and ensure that the officer looks for every excuse to write more things on the ticket, or hold you while he scrapes the barrel for PC or warrant searches, sure. All he has to do is "smell marijuana" and your arse is sitting there waiting on the dog for a free air sniff. Why would any of that ever be worth it? shite, even if you have drugs or whatever--they're going to get them anyway.

Normal people just interact like a human, answer innocuous questions, and go on their way quickly.

100% of people who run afoul with LE's are guilty.

Either you did what they think you did, or your did some other illegal shite and are coping an attitude because your fight or flight mode has kicked in.

Its not really about what they are and aren't entitled to. Unless you are in the midst of committing a yet-undiscovered felony, far and away the most pleasant and efficient thing to do is communicate like a respectful adult.

Refusing to answer questions is only going to slow you down at best.

I got pulled over recently for rolling through a stop sign.

I also had no proof of insurance (new company vehicle)

Cop asked where I was coming from, where I was going, etc.

I answered and was very polite, as was he. He went back to his vehicle, ran my plates and license, returned and sent me on my way with no ticket and a “have a great evening sir”

If you want a guaranteed ticket, feel free to be rude. It’s certainly within your rights, but not the smartest move.
