That depends upon what actions the "business" takes. For example, if a business advertises itself as being safe and taking precautions but then does not take reasonable ones, and if the business is an NBA team with thousands of fans, many of whom all contracted the virus within 5-14 days of attending the same game at a time when new infection rates in the area was very low, well . . . that might not be so hard to convince a jury as to negligence and causation.

And your scenario has the obvious flaw of not being able to prove a negative.

If your example person came from outer space, attended an event, then immediately went back to outer space then it might be proven.

Otherwise, the person infected could have come in contact with the virus as it was suspended in air or surface borne without direct human contact before or after the event.

Because in LA you can sue for everything and if you play your cards right and ask for a certain amount, you can get a sympathetic judge to make the call on your behalf.

They could have come in contact with it while walking on public land while heading to the stadium.



Why not sue the person who gave them the virus?

Where in your scenario was Person A forced to attend the event with thousands of people?
