Which makes one a bigger a-hole?

A) Leaving a guy in jail without having a clear idea on charges

Or

B) release someone prone to committing acts of violence on others to commit violence

I dont care if this is "unfair" to Moore. He demonstrated that he doesnt deserve the benefit of the doubt and hes a danger to innocent people.

Negative. It can be weeks or months. Whether you sit in jail during that time is a function of your bond. The bond is set within 48 hours but it’s based on what you were arrested and booked for. Formal charges generally come later. At least in Louisiana.

I already said I wasn’t talking about this situation in particular and asking about the weirdness of the statement so what’s your point?

This case is a lot more interesting than I thought..

Now I've learned the dude is suicidal or a danger to other people..

He threatened to kill his mistress and then himself.

He should be under care of a prison physician for minimum 60 days before they evaluate a charging decision. He is still a threat.

48hrs is the max without a warrant, but if he threatened to harm himself there are different rules for holding but there’s evals/treatment generally involved.

In a perfect world, police would have the case ready and file for a warrant before making an arrest. But this is not how things work in a live-action world. They make arrests as things happen in real time which means that they often need to prepare at least a start of the case after the initial arrest. Most states and federal laws allow them 72 hours to get this done.

I was in court in Oberlin one day and they brought a Texan in who had been in jail for over a week on s speeding ticket, before arraignment. There was a holiday and cops had forgotten about him. Judge was apologetic and released him w time served.

In domestic situations, a person may be held without bond for generally 48 to 72 hours as a "cool down" period so they don't leave still mad and kill someone.

Otherwise, 60 days to file a bill of information for most felonies.
