Which makes one a bigger a-hole?
A) Leaving a guy in jail without having a clear idea on charges
Or
B) release someone prone to committing acts of violence on others to commit violence
I dont care if this is "unfair" to Moore. He demonstrated that he doesnt deserve the benefit of the doubt and hes a danger to innocent people.

Typically arraignment happens within 72 hours
Negative. It can be weeks or months. Whether you sit in jail during that time is a function of your bond. The bond is set within 48 hours but it’s based on what you were arrested and booked for. Formal charges generally come later. At least in Louisiana.

I already said I wasn’t talking about this situation in particular and asking about the weirdness of the statement so what’s your point?

If he screamed Allah Akbur while trying to stab that woman he'd get a medal and parade

Don’t waste your time on Dingo. He’s just a CPA. He’s not a lawyer.

This case is a lot more interesting than I thought..
Now I've learned the dude is suicidal or a danger to other people..
This keeps getting better.

He threatened to kill his mistress and then himself.
He should be under care of a prison physician for minimum 60 days before they evaluate a charging decision. He is still a threat.

I believe so. That's what I read on the MSB.

Supposedly he's a threat to himself and others. I don't think they can release someone if deemed a threat.
Wonder if it would make more sense for him to be involuntarily committed to a psych institution in this case.

I never offered because no one asked. Dingo was the only one that eventually asked what else I do.

Good, hope they both received their writ of habeas corpus...

you can be under mental health observation at a correctional facility/jail with the right staff observing
Seems like a jail would be about the worst fricking place on the planet to be if you had mental health issues

48hrs is the max without a warrant, but if he threatened to harm himself there are different rules for holding but there’s evals/treatment generally involved.

In a perfect world, police would have the case ready and file for a warrant before making an arrest. But this is not how things work in a live-action world. They make arrests as things happen in real time which means that they often need to prepare at least a start of the case after the initial arrest. Most states and federal laws allow them 72 hours to get this done.

I was in court in Oberlin one day and they brought a Texan in who had been in jail for over a week on s speeding ticket, before arraignment. There was a holiday and cops had forgotten about him. Judge was apologetic and released him w time served.

In domestic situations, a person may be held without bond for generally 48 to 72 hours as a "cool down" period so they don't leave still mad and kill someone.
Otherwise, 60 days to file a bill of information for most felonies.
