Yes that is typical, but he said that the other party’s insurance bought him another car.

What you described is subrogation, a different process.

Talk to lawyer, but also don’t sign off on closure once they send the insurance check. You can leave it open so if she has some pain years from now, she can go back and claim it was due to the accident

Also things like, unable to get pregnant, kidney issues, etc that could be linked back to the accident

The first thing you need to do is get a good lawyer. The second thing you need to do is seek treatment. If you want compensation for pain and suffering I assume you experienced and are experiencing pain and suffering. The way you prove that is with medical reports from a doctor. If you try to settle without that you will be settling for peanuts.

FIL got in a wreck last year going to work. He was in a company truck and someone ran a red light and plowed into him. No major injuries but he did go to the hospital. Took almost a year to finalize it but he did get $60K after lawyer fees.

I got in a pretty bad wreck. Some bitch failed to yield and hit me, knocking me into a pole. I had to be taken to the hospital. I had a slight concussion, bruised up with a cut under my eye and some other cuts here and there.

I wanted to leave the hospital and go back to work. I was advised to take the week off (it happened on a Wednesday or something). At no point did I ever think of "pain and suffering". Did it hurt? There was discomfort, but the best way to fix that is to not stay laid now.. Your body gets stiff so you just got to keep going.

The girl who hit me had just gotten insurance less than two weeks before hitting me and her policy evidently didn't kick in under after two weeks. Either way, if you are not staying over night in the hospital I don't consider that pain and/or suffering.. But I don't know how it all works legally. All I expect is for my vehicle to be where it was before it got hit. Unless, I had to be out for 2 week + or something.

I am not a lawyer, but I handled claims for a company that gets sued a lot due to the nature of the work. I loved it when the claimant went to one of the settlement factories, Gorden, Morris Bart etc., that meant the case will never see a courtroom. Gordon et al like volume, they want to settle your case ASAP, depositions and expert witnesses take a lot of time and money, they will sell the case to another firm before they do that, unless it is in the major bucks category.

Get a real lawyer, use a friend's recommendation or something other than a TV lawyer.
