People in other states hope they win the lottery, folks and their lawyers in Louisiana hope they win the car accident lottery.

I have battled those clowns for a long time, and like to think I have some insight into their mindset.

They are cynical as hell. They know they are appealing to the lowest common denominator in society. They know what educated, right-thinking people generally think about them, and they don’t care. It’s about making money. Huge piles of it.

And our legal system is rigged to give them a clear lane. Why? Because personal injury lawyers for years controlled the legislature. Maybe not so much now, but the damage is long done.

It is pretty bad if personal injury lawyers, as a group, are considered to be “worse” than insurance companies.

The scum of the entire legal profession.

I am certain we know each other.

For those who don't know, the Arizona decision was a commercial free speech opinion regarding lawyer advertising.

I have driven through (and listened to the radio in) a number of Midwestern states and in either Ohio or Indiana I did not see a single lawyer billboard and didn't hear a single ad on the radio.

Same Constitution. Louisiana should adopt their rules.

Then why are rates so much cheaper in other states? If they would just come up with other excuses, why are our rates not the same as every other state?

Highway density, road conditions, credit scores, outrageous financing agreements, etc. ... and yes lawsuits all contributes to the price of insurance rates

Not defending PI lawyers, but that is more a function of most other businesses realizing that the super expensive advertising costs of local ads during local news isn't worth anything. It's one of the biggest ripoffs in advertising other than 1-3 billboards.

So a person shouldn't be made whole by the company who assume liability for the said property in case of an accident???

Only two ways to change it. One is to contact your legislators and raise hell but good luck with that. Lots of lawyers are legislators and the lawyer lobby is very strong. The other is to serve on a jury in a civil suit and you and the other 11 members see through all the B.S. and make a reasonable award or send the plaintiff home with nothing.

I don't really know what they can do. There are only a few more bullets in the magazine to try.

If medical providers will engage in borderline fraud, while being given legal protections and juries will award large sums, there is only so much you can do via regulations of civil procedure.

Ultimately, if there is liability and a history of treatment, juries will decide the damages based on that medical history.

There was a trial lawyer ad at the bottom of this thread page.

It is a major issue.

There's a reason new companies don't come here and the litigation climate is a BIG one.

I have a cousin from France that came down to visit a few years back. We were showing him around south Louisiana and he made a comment on all of the billboards for personal injury attorneys. He asked why we had such a problem with car accidents here. Dude must have thought we had the world’s worst drivers.

You know, up until 1977, lawyers were prohibited from advertising.

Except Louisiana has embraced the advertising like no other state I have visited. When we visit Louisiana, my kids always comment about the billboards. They pick a favorite and then see whose favorite has the most billboards.

When I first moved out of state, I went to the local insurance agent to update my auto policy. He sat down at his computer to get my current info and prepared me for the worst. He said how the new state had really high premiums and I need to be prepared to pay more. When my policy info loaded, he said “My God! What kind of drivers are there in LA?” I told him the drivers were like anywhere else but we had bad lawyers.
