They are still going to have liability. Lighting rods, grounding systems, lightening protection systems are a thing and should be in place. If a petrochemical plant in Louisiana can’t take a lightening strike it’s going to blow up. Not if, when.

Honestly I’d be shocked if the first suit hasn’t been e-filed already on behalf of an individual representing a proposed class, with the plaintiff lawyer wanting to be on the steering committee. The Ads will soon follow. A large number of individuals and business in a 25 mile radius will be filing claims, from personal injuries, environmental damage, property damage, and business interruption.

Yeah but proving the negligence will be harder than if it was a lack of safety equipment or training.

True,

And as I said earlier, there are certainly different degrees of negligence. Again, if there was a known issue that was brought to management attention and not acted on, that's a far different animal than perhaps an oversite or underestimation of some other risk.

The company assets all burned up or leaked out. Company is done.

The costs of this massive cleanup are going to be well in excess of this company insurance plus assets. By a large multiple.

I think the attorneys will quickly realize they ain’t much to go after here. Given how fast and loose the company was with regulations, I doubt they were insured and protected for this scale.

This is an absolute excrement show.

At this point, the only interesting thing will be if there is any corruption or criminal liability of those in charge… or if any government officials were turning a blind eye.
