It's a DV case, in which the murder wasn't planned. The TPOS acted out during an act of rage, and thus, malice aforethought wasn't present.

Malice aforethought is not a part of the first or second degree murder statute in Louisiana

Got nothing to do with it. Premeditated murder is murder 2 without some aggravating circumstance - ie, during commission of a felony, killed LEO, old person or child
