Federal push against violent crime in Chicago underway - bypassing local prosecutors

Since late July, the Feds are going in hard against violent criminals in Chicago. Word is getting out that a gun charge in Cook county may not just mean a walk through a revolving door like it used to. It could mean hard time in a distant prison.

Gun violence has spiked this summer to levels not seen in years, claiming victims as young as 1 year old. Earlier this month a shooting outside a funeral home saw 15 people wounded — the worst mass shooting in recent Chicago memory. Some sources said an increase in the amount of federal resources paying attention to Chicago violence was likely to naturally lead to more federal prosecutions.

But the concerted push has apparently led to some confusion within the Cook County state’s attorney’s office, which has historically handled the vast majority of Chicago gun felonies.

On July 25, just two days after Trump’s Operation Legend announcement, an email sent by a high-ranking prosecutor to attorneys in the Felony Review Unit said Chicago police would be taking all gun arrests to federal agents first, giving them the right of first refusal in deciding whether to bring charges.

State prosecutors were directed to consider charging a gun case only if federal prosecutors had declined it, according to the email, which was obtained by the Tribune.

Not only does the federal charge of unlawful possession of a weapon by a felon carry a maximum 10-year prison sentence, defendants must serve 85% of their sentence, instead of being eligible for day-for-day credit in the state system.

If a defendant has previously been convicted of three or more violent felonies, federal prosecutors can seek an enhanced, mandatory minimum sentence of 15 years behind bars, or up to life.

Defendants convicted at the federal level also may wind up serving their time in faraway states, which tough-on-crime advocates have long said can act as a deterrent in and of itself.


I'm kind of on the fence about this, but something had to be done. Violent crime was spiking in Chicago this year.

ETA: In all seriousness the federal government is there for this reason. Chicago is having havoc wreaked upon it and apparently the local authorities are either unable or unwilling to deal with it.

But I agree with others that federal intervention in local matters isn’t something to take lightly. But it seems like Chicago is actually asking for the assistance so if that’s the case then I say this is for a good cause.

I love that this is happening but I am beyond pissed that the local governments are letting these criminals run wild. I hope this ends up being successful but I hate the fact that the Feds are getting more and more involved in the affairs of the states and municipalities. It's not how the federalist system was suppose to work but these jackasses push it to this point because the votes of these criminals and their families get them elected.

I'm the definition of sweating man with two buttons on this one

I prefer a very small federal government, but when local governments fail to maintain law and order, it IS in the government's purview to guarantee the public safety.

It's a tough one.

What's your hesitation? If it is illegal for you to carry a gun because you screwed up in the past...don't carry a gun, you'll be OK.

Any infringement of constitutionally protected rights is the business of the feds. It is also the business of every level of government to protect those rights but if they don't the feds have to.

It’s always boggled my mind that progressives cry “more gun control” all day long, but then have no interest in actually punishing people for breaking gun laws.

My guess is the reason for that is that the DA doesn’t want to punish black and Latino people.

Read “Bonfire Of The Vanities” and its take about how DAs always want the great white perpetrator because that looks good for them instead of hailing a bunch of minorities.
