you are claiming they had no right to stand their...and all they had to do was leave.

They could have left. so could the other guy. Im unsure what you are argueing.... 2 trash have guns... 1 trash threatened to kill them multiple times, 2 trash say they will protect themselves, 1 trash does something you cant really see, 2 trash shoot their guns....

This isnt as cut and dry as you are trying to make it.

I remember this and how tense that video was when it was posted here. I'm torn on this one. If you made me choose a side I guess I'd choose the dad/son, at least initially and especially if the deceased dude had a bat (saw that mentioned).

The confidence that some people have that they won't get shot, while goading an unreasonably calm man with a gun, is insane. Old man was calm as frick (on the surface) and was all business when he said he would kill that dude, and yet he kept screaming and antagonizing him. The son acted like an idiot, but the old man was in full business mode.

I imagine they'll end up seeing jail time, but it seems like self-defense or stand your ground is fairly easily in play here. I'm interested to see what comes of it with this (finally!) going to court.

Anyone with gun training in self defense situations are taught to ALWAYS deescalate first, get away from the threat if you can, and as a last resort, defend your life if you feel your life is in immediate danger (or the life of someone else). Those two knuckleheads had every opportunity to walk away (they are not defending there own property) and wanted to play cops.

None of which has anything to do with the legal standard.

They can stand there, never said they couldn't.

I've never said otherwise.

My argument is they escalated by bringing weapons into a situation none were in. Those chose to not deescalate. They shot before that bat was thrown. That is all clear as day on the video.

IF you see justified self defense in that situation, we aren't ever agreeing. But you can kiss my arse implying I'm not for freedom.

Fatdad shot before the baseball bat was thrown. He's guilty of something.

Arming yourself with a weapon and approaching close to someone will be enough to justify self defense shooting.

So using this logic, the dead guy was defending himself since he was unarmed at the beginning of this confrontation.

You don’t need to give the guy first swing before you can justifiably defend yourself.

Exactly. I’m surprised so many people here have this wrong. I suppose they’re shaded by the F/S’s utter trashiness.

Dudes would not last 5 min in pickle ball.

Should be min requirement to own a gun.

you dont know what the situation was before the video. I just watch and you dont know what happenes right before the shits as the video was filming the ground.

As the other guy here said... by law you do not have to deescalate. They is taught in carry classes because doing so will make your case easier than this one.

IF you see justified self defense in that situation,
again it is not that simple. And i think in Texas it is more relaxed that other states. You are just trying to make this clear cut and its not.

well you are automatically trying to place blame on some trashy people because they are just standing there.

Threatening to kill two guys that have guns was a bold move.
