The parents of a toddler who fell to her death from an open cruise ship window in July are telling why they filed a wrongful death lawsuit against the cruise line. Chloe Wiegand's family blames Royal Caribbean for failing to "provide reasonably safe children entertainment areas, including reasonably safe windows."

The girl's grandfather, Sam Anello, said he lifted her to what he thought was a closed window when she fell from his arms. He is charged with negligent homicide in Puerto Rico, where the cruise ship was docked.

quote:

This week is especially hard for the family because Chloe would have turned 2 years old on Friday, CBS News Correspondent David Begnaud reports. Her mother, Kim, said she should be getting ready to celebrate with cake and presents, but instead she spends time every night with Chloe's urn.

quote:

Asked if he believes Chloe's death was an accident, family attorney Michael Winkleman said he does. "Then why sue the cruise line?" Begnaud asked.

"Because they could have and should have done more to protect Chloe and to protect other kids," Winkleman replied.

quote:

Chloe's parents reiterated that argument. "If they would have followed the safety codes and updated their ship, all their ships, then it never would have happened. She'd still be here today," her dad, Alan, said.

"We want them to fix their cruise ships so that no other kids get hurt," Kim added.

quote:

Asked if the family supports Anello, Kim said, "Of course we do. … We've always been a family. We continue to spend time together weekly. We continue to share dinners together."

What a strange story. If gramps is being charged with negligent homicide, how exactly can they sue RC when RC had nothing to do with the toddler's death?

Isn't the country where this happened looking to charge the grandfather?

There is video of this. It either shows the grandfather being negligent or it doesnt.

Toddlers don't just fall out of windows that are 4 feet off the ground by themselves.

Was the window completely open or just unlocked so when pressure was put on it, it swung open? I haven’t really been following this

They already warn you against picking kids up to railings or windows. Their grandfather accidently killed the kid and the family can't accept that so they sue.

everything I've read since this came out is that it was open and the grandfather didn't notice there wasn't a pane of glass there.

From what I've read, grandpa essentially hoisted her up so she could see out the window, the child leaned forward, and fell out.
Gramps thought that was a closed window six inches in front of his face. Anyone who's been on a cruise ship, there are typically winds blowing on the upper decks, so it's pretty obvious if window is open or closed.

There wasn't a window at that point. Their grandfather thought there was a glass panel. But it was an open space in the wall of windows.

Not sure where the suit is pending but most states have some form of comparative fault. Even if the grandfather has some negligence, the cruise line could also have some percentage of fault.

So the family wants all cruise ships “updated for safety” to have no windows that open? That’s their solution?

Their argument is about RC allegedly not meeting industry standards.

quote:

He argued the cruise ship did not comply with industry safety standards, including having fall prevention window guards, screens and a device that would have limited the window opening to four inches.

"It's our clear allegation in the complaint that they either knew about these window safety, window fall prevention codes or should have known about them because it's the industry standard," Winkleman said.

What a terrible tragedy.

I've been on cruises on a number of different ships and cruise lines, and I have never, ever, ever, ever seen a "window open". There are just no such things as windows that open. Either the window is fixed of there is no window at all.

This just doesn't make any sense.
