As several folks here predicted, the family settled with Schlitterbahn and the terms of the agreement are sealed. I wonder what kind of number you put on a tragedy like that.

The family of a Kansas lawmaker's 10-year-old son killed last summer on what was billed as the world's tallest water slide reached a settlement Wednesday with the park's owner and the raft's manufacturer. Terms of the deal filed in Kansas' Johnson County District Court involving Caleb Schwab's family were not released.

A spokeswoman for Schlitterbahn Waterparks and Resorts, Winter Prosapio, confirmed the settlement, which was first reported by The Kansas City Star. But she declined to elaborate, other than to say the park's owners plan to follow through on permanently removing the slide from its 168-foot tower as announced in November. "We'll have an announcement in the future about what will go in its place," Prosapio told the AP. "We are very anxious to take it down, and hopefully this (development Wednesday) will be another step in that direction."

I don't blame them for avoiding a trial and having to re-live that incident more than they already do.

Is that the child that was essentially decapitated? What about the other people that were in the slide with him. I assume they will need therapy for the rest of their lives.
I would think it best for the family and the park to settle out of court and move on. Terrible tragedy.

They should go ahead and close that park before they damage the reputation of the great original park in Texas any more.

I'm sure that family would gladly return every single penny of that money and then some to have their child back.

I think they max in KS is something like 250k due to their tort limits.

Is this the case where the operator put a fatty on the back, and this kid on the front?

I hate to say it but most families in America would give up a kid to be set for life monetarily

You can't be serious. Insurance would be cheap as hell. And, you just can't be serious.

Why would tort come into play?

Kid knew he wasn't old enough for ride.

This doesn't answer your question, but I remember the early reports saying he was on a raft with 2 women. Conjecture was that they were likely under the required minimum weight. I read today that the other two passengers were 197 and 275. They were over the minimum by 145 pounds.
