What kind of money does this two bit outfit have? It's not like it's Disney with millions to toss around.
They are probably already hemorrhaging money with reduced ticket sales, cost of taking down the ride, PR firms paid, lawyers paid, etc.
I doubt the family got the type of money we are thinking

It's a pretty big outfit that was also likely well insured.

It wasn't the outfit which settled, but rather its insurance carrier. Probably had a general liability and an umbrella policy.

From what I recall reading, this ride had a history of people getting hurt. I think there was likely enough of a risk of getting hit for punitives (allowed under Kansas common law) that they blew up the liability and may have gotten all of the umbrella.

Just pulling a number out of the air, id guess $1,000,000 liability and $5,000,000 umbrella. These are numbers I've seen on a lot of commercial policies.

I read that one of the Velcro straps came lose and the boy went flying into the steel net support on the second crest.

If that is true, it was equipment failure.

Can't find a pic. In the old wchlitterbahn park in tx. You had to lug a 40 lb sled up several flights to ride the sled ride at what was the original park. Went from 2.5 story roof down.

That's only for pain and suffering and I'm pretty sure it's per plaintiff. So while it seems low, it adds up quickly. You also have to look at who has standing in KS to sue

What else would there be in a wrongful death case of a child at a water park. There are no economic damages. In FL there is only one Plaintiff (personal rep of the estate) but there can be multiple beneficiaries. Caps are complete arbitrary bullshite

I'm sure you're right. I read something that waterparks are moving away from draconian height restrictions to a more politically correct age limitation. This way no one other than young children get their feelings hurt.

My daughters and I rode that just a few days prior to the accident. My best friend and his family came up from Haughton to visit and they wouldn't ride. We smirked and laughed...we laugh no more. It has changed the way I think regarding amusement parks in general. I will no longer take an engineers work and design's success for granted.
