For inconvenience damages for a few hours of power outage? Has your looking revealed the cause of the outage faster than Entergy could identify it? Do you have suggestions on how Entergy could have resolved the outage more quickly than they did? You have experts ready to testify how Entergy should better run a power utility? Just curious what results this looking has brought you.

This is where you can win your lawsuit. There has to be a paper trail somewhere that these guys were blowing smoke. Can you get your wife to fake a medical condition that was exacerbated by the outage?

We were a British firm….eight times larger than Disney. They wrote the check and settled for seven million.

So you win a suit.

Then what? City Council regulates ENO and sets rates. Zero sum game.
Broke arse NOLA ratepayers would be on the hook and Council wouldn’t approve the payment anyway….

Where did you see him bitching about his rates?
He's bitching about the power going out and being unreliable.
Fine their stupid asses when somethign like this happens.

If they don't have adequate equipment that can run when it's hot, or backup equipment, then maybe they shoudln't be the utility company in charge of that site.
Under no circumstance should we not have power b/c a utility companies power plant is down. That's inexcusable, unless some act of god destroyed it. Heat is not an act of god. a tornado ripping through it is.

I'm with you. We live in Gonzales but it's the same utility(Entergy La). Our stretch of Entergy(about 200 customers) experiences outages at least once a month of over an hour or more. Nobody feels like they have any control over this.

I'm in.

Super Bowl power loss was because of super dome officials refusing to listen to Entergy.

Read the lawsuit.

Entergy is a publicly traded company. Effect change the American way: buy up the shares of stock until you have majority stake and then fire them all at the top. Form an alliance with the shareholders to oust the directors and the board, or run for office locally and begin the journey to become public utility commissioner and yank their business permits.

Or one can always relocate to another area Entergy does not operate in.

Thank you sir, you get it. Don't forget that Nola was under a citywide boil water advisory less than a week ago because Entergy's infrastructure was hit by a mylar balloon. In other words, a balloon you buy at Party City. It's comical.

I'm exploring several legal theories, including continuing tort. Since my house loses power so often for no apparent reason going back years, the ongoing negligence and want of care and skill will be easy to establish. Damages are obviously for aggravation, but there are ways to increase damages such as through unfair trade practices claims. But it's not about money, it's about making an example and proving a point.

Exhibit A will be the mylar balloon, if I can get it in discovery.

You can't rely on Gov't or Utility company. You must regain control yourself. Buy a generator.

Mylar balloon is a terrible example to think you have a slam dunk case. What are you going to do to protect against a metallic object contacting a power line and causing a fault?

Honestly, you absolutely have to do this sometimes.

I took on the largest credit reporting agency and those thieving cocksuckers backed down.

They were literally screwing honest small businesses and straight-up committing extortion.

I made national news and I have the article hanging on my office wall.

While you're at it, I'd sue Big Mylar too. They're manufacturing a dangerous product that is a known threat to electric utilities, wildlife, fisheries, and the environment in general. This seems like a slamdunk.

Your example sounds like a pretty apparent reason.

Reminds me of the guy a few weeks ago complaining about how his power was going out every other day in clear weather. “We haven’t had any storms since Sunday,” the guy said. Well, it was Tuesday and after reading the guy’s post it became apparent that his power had gone out Sunday and Tuesday. So by “every other day in clear weather” what he really meant was “twice in 3 days, one of which happened during a severe thunderstorm.”

Don’t get me wrong, failures due to pure neglect/lack of maintenance certainly happen. Especially with Entergy New Orleans. But I would venture to say that the vast majority have fairly obvious causes - ranging from falling tree limbs/trees, to lightning strikes, to dumbasses driving into telephone poles, and even to dumbasses releasing metallic balloons underneath power lines.
