Employee files false unemployment claim

As the employer, no need to file separation notice because still employed. Can’t seem to find appropriate link at La Works to refute the claim so it will get flagged. Anyone know what to do?

Did you lower their hours or anything? I'd probably see what happened first before I fire the guy, could have had his identity stolen too.

Currently, you can file unemployment while still being employed if your place of work has reduced hours due to covid 19 in LA.

I’ve had about 30 employees file and their hours haven’t been reduced at all

I’ve got 2 for you:

1. Right before the CV hit, we made an offer to a possible employee who accepted. We then had all employees work from home so we put her start date on pause as we wouldn’t be able to train her. About a month ago I get a letter from department of labor that she filed unemployment against us. She never worked a second for us.

2. Today I got a letter from the department of labor about a former employee also filing a claim against us. This employee QUIT her job in December of 2018.

We denied both.

Had she already given notice to her former employer when you put her start date on pause? If so, this is a dick move.

Individuals who are facing a reduction in hours and/or a being mandated to stay home by their employer, a healthcare professional or the government could also be eligible. Individuals may be eligible for unemployment benefits if they meet the monetary criteria and the weekly eligibility criteria. You will be required to report your weekly gross wages to determine eligibility each week you submit your weekly certification. If your gross wages are more than your weekly benefit amount, you will not be eligible for benefits.

This info is easily found within a few seconds of going to the LA site.

It's amazing/scary to me that people who in a position of power to control someone's income cannot figure out stuff like this.

You have to be available to work in order to collect unemployment. So assuming you can drop whatever you’re doing and report to work, there’s nothing stopping you from filing. One could argue that an individual with a legitimate need for unemployment assistance would not take issue with this requirement.

What if it's X-mas or you were taking your kids somewhere for the summer.

They don't stop taking unemployment out of your check when you are vacation from your job. They shouldn't stop giving it when you go on vacation.
