What if it's X-mas or you were taking your kids somewhere for the summer.

They don't stop taking unemployment out of your check when you are vacation from your job. The should stop giving it when you go on vacation.

1. Most (but admittedly not all) employers will pay out unused PTO if they terminate you. If this happens, you’ve already been paid for that vacation anyway.

2. Even if you don’t get paid for unused PTO - if your family vacation is more important to you than unemployment benefits, then you don’t really need the unemployment benefits. Unemployment is supposed to provide income while you search for a job. If you can afford to wait a week or two to start looking for a job, you can afford to wait a week or two to claim unemployment.

1. Right before the CV hit, we made an offer to a possible employee who accepted. We then had all employees work from home so we put her start date on pause as we wouldn’t be able to train her. About a month ago I get a letter from department of labor that she filed unemployment against us. She never worked a second for us.
she should get unemployment. She was ready and available to work and this happened through no fault of hers

This info is easily found within a few seconds of going to the LA site.

It's amazing/scary to me that people who in a position of power to control someone's income cannot figure out stuff like this.
Hey man, how can you brag and show off to the OT if you can't come here and post dumb shite about owning a business or denying people's unemployment claims?

If the Job was offered and accepted, she was in your employ even if she hadn't worked an hour yet.
The unemployment claim is legit. you should correct your error.

As others have pointed out, someone reduction of hours may he eligible for unemployment. I think a person who has multiple sources of income (which could include a self-employed job) may be eligible if they’ve lost enough income from one of those sources.

So if I were you I would get up to date on the new unemployment laws and regulations and also then talk to the employee to see why he filed unemployment and if there was a justified reason based on the new laws. Also, maybe someone fraudulently filed or something.

Are you kidding me? You gave her a job offer in writing and she accepted. All while likely leaving her now former employer, which I'm sure she's now regretting. A month has gone by and she still has no income and no definitive start date in sight. I would be livid. That's not how you treat an employee, especially one you're giving a first impression to.

People who received a job offer but weren’t able to start/train for that job are eligible for the $600 a week stimulus. That’s why she filed.

You don't get unemployment if you are on vacation?

Or if you travel, can't work because you're caring for someone, in the hospital for cancer treatments, going to school full time.. good chance all of those disqualify you for a period of time.

It's not a welfare program, it's an insurance program with a highly protected trust fund.

Currently, you can file unemployment while still being employed if your place of work has reduced hours due to covid 19 in LA.

Great. Why even bother being a useful part of society. It's just an invitation to government-enabled thieves.
