Dwi are all about revenue. Wanna stop dwi’s? Put breath recognition into every car but the police would be against that because it stops their gravy train.

What would be the legal basis for depriving the other people of their property and their means of continuing their travel?
The taking of the vehicle is not a penalty, but rather a means of securing the vehicle and keeping it from being a roadside hazard.
In our system, consequences are given by courts after a trial rather than police at roadside.

I miss the 80’s where DUI wasn’t even a thing. You would go out, get hammered, drive home. It was great! Even if you got pulled over, the cops would just confiscate your beer and let you go.

Ahh, the good ole days. Until those Karen’s from MADD decided to make a big deal out of it. Those nosy old women really ruined a good thing.

That's exactly what happens. And they lose their license for 6 months, and could face jail time. And pay $10,000 or more in fines and penalties, not to mention the resulting cost of higher auto insurance premiums. It often results in job loss as well, and I wouldn't doubt divorce, or child custody issues too.

Contrast that with texting and driving. It causes far more accidents and deaths, but no one cares about that. If you are caught actively texting and driving, it's a fine and that's it. No MADD, no soapbox, no villyfying, no emotional outcry, just a PSA or two asking people to put their phone down, which no one pays attention to.

SIAP. Some of you are focusing on the .080 BAC and arguing (probably correctly) that you're not "drunk". Impairment is hard to prove, intoxication isn't. Same as on the jobsite, except they will run you off at .001 BAC.

You sidestepped the legal basis for seizing the property and depriving those other people of their ride without due process.
The US Constitution's ban on such practices is still applicable.

I don't think law enforcement is giving up on that revenue stream, especially when you can get a DWI sleeping in the back seat of a truck with the AC on.

handless is the exception here but I’m pretty sure there’s nothing that the cops, or NSA couldn’t dig out of your phone if they wanted it

People make stupid decision. Everybody has made them even if it wasn’t driving while driving high or drunk.

I can look past once as a learning experience but multiple times being arrested for DUI is the problem.
Once should be painful penalty of money, time and publicity.

Anytime afterwards should be long prison penalties.
