Maybe not that alone but her previous rulings and personal relationships with a rapist should be enough. She’s shown a clear bias toward those with rape charges.

A bit unusual that you think trials should be brutal for parents of a victim (which is who the comment was made about). I’ve seen some harsh comments on the OT, but this is up there with the harshest.

Yeah I don’t get the hate here. Unless they’re just victim blaming. I don’t know how this can be pinned on the girl at all. She was shite faced, raped, and left for dead.

Pretty weak.

The legislature already gutted the jury waiver a few years ago and now Moore wants to set the precedent that a proper waiver done within the restricted, pro-prosecution timeline can be cause to recuse a judge who has heard motion practice in the case prior? That's a bit too much.

Not an attorney, but as I understand it, it all depends on the circumstances. Any form of serious loss of motor control, disorientation, incapacitation, or unconsciousness usually means someone is not legally capable of giving consent, even if the person verbally did say yes. Consent is also considered to be "ongoing". That is, a person can legally consent at one point but then becomes incapacitated during the act. In that case, consent is no longer possible and you put yourself at risk if you do continue. I personally think the defense is going to have an uphill climb with the official BAC of 0.319 or whatever it was. That's considered very close to alcohol poisoning in most cases.

As far as your questions, yes, some people are probably unwittingly rapists according to the law.
