So charge the crime. The state of the offender is inconsequential. If you harm innocents, it doesn’t matter what you did or didn’t intake.

The offense should be the crime, not the state of alteration it was committed in

That's pretty stupid. If DUI is the cause of the accident, that is the crime. The "state of alteration" is all that matters.

How do they know he wasn’t under the influence of the radio and that caused the wreck? Whatever artist he was listening to should be outlawed! Think of the children!

If you crash into someone else, does it really matter the reason, whether you were drunk or stoned or texting?

even if this is true, how many marijuana deaths v. alcohol or tobacco deaths can be credited to date for 2018?

bible belt retards love these stories to prevent marijuana legalization in their states even though it has been proven safe in other states with less stupid populations.

Dear lord the "muh weed" defenders all up in this thread thinking it's an attack on their precious drug.

Look don't drive while under the influence of any mind altering substance. That simple.

Well this is obvious from reading the first statement.

But seriously...

RIP to the poor souls who passed. Seriously. It really is tough to hear of someone passing from someone else driving recklessly.. Whether sober or not, It's a shame to hear that someone loses their life because of someone else's mistakes on the road. Goes to show that it can happen to anyone at anytime... Breaks my fricking heart every time hearing of someone leaving us because of it...

Damn... would have to happen 8 more times today to reach the 28.75 people killed every day by alcohol impaired drivers.

Nothing wrong with drinking. Nothing wrong with smoking. Neither should be done while driving. Pretty simple.

Penalty for doing so should be equal and harsh. Equal money should be spent on education against driving under the influence of any substance.

I've said this many times.

First offense for any kind of distracted driving, 1 year in jail, loss of license.

Second offense, lifetime sentence.

I don't want distracted drivers on the road period. Drinking, texting, drugs, none of it.

Does this offense fall under the category of High Crimes & Misdemeanors?

If you are ever personally affected by a drunk/distracted driver, you will change your mind on this.

i think it matters in terms of sentencing purposes with regard to intent. if you hit black ice and kill someone, it's different than getting behind the wheel impaired.

that said, marijuana doesn't kill people, irresponsible and careless people kill people.
