Do criminal defense lawyers want to know if their clients did the crime?

I am watching a Law and Order rerun and the seemingly guilty lady just ask for a lawyer. I wonder do the lawyers want to know if their client is guilty or not? Should the defendant spill the beans to their attorney or not???

I can’t say, but if I had to be a lawyer I would not want to be a criminal defense lawyer. I could not in good conscience defend someone who I knew in my heart was guilty, especially for a violent crime. I guess you have to have your brain wired a special way to justify it.

My brother is one. He doesn't give af. He just represents them to the best of his abilities. He's a true believer. I couldn't do serious criminal defense.

To most efficiently defend your client it's best to know the truth. Then you build you're defense accordingly. Knowing what to avoid. But yeah, you have to wonder about the morality.

I am a criminal defense lawyer. Yes we want to know. If we know the worst we can work with the evidence properly. If we don't, we will get surprised at trial and it generally hurts our client's case. You have to explain this carefully to the client early, because they want their attorney only to know facts favorable to them. The attorney client privilege keeps you from divulging any incriminating information you receive this way.

Mrs. S is in criminal defense but most of her cases have been drug related stuff. Just trying to make sure they have a fair trial.

On the other side: my dad was a prosecutor for 25 years and never had threats or anyone try to get revenge on him because he treated everybody with a level of respect and never got personal about it, no matter what they were accused of. Most of them were either people who made one Bad mistake and were never going to offend again, or people who viewed getting caught as part of the cost of doing business.

That's one thing lawyer shows get wrong. They're so damn passionate about everything. Most of the time it's just a job.

I've wondered the exact same thing before.

How tf am I supposed to live with myself by defending someone if they flat out said,"yea I killed the mf. He had it coming. Now it's your job to help me beat the charge"

Look at a criminal defense attorney’s job as one making sure the prosecution does their job correctly. If the defendant did the crime and that can be proved, they need to do it correctly so it’ll stand on appeal.

Yes they absolutely should know everything to, as one poster said, not get surprised at trial.

Have an attorney friend, not in this area but others in his firm are, and you have to know what the job entails before practicing in the area. It does take a certain “wiring.”

You can always get out for ethical reasons, but on the other hand there is the ethical concept of everyone deserves representation and constitutional rights. It’s the basis of our legal system.

I always want the truth from them. Sometimes it's tough handling the truth, but it's important in pushing for the best outcome. Usually they're scared and truthful.

I’ve practiced criminal law before.

Every clearly guilty people deserve to have their rights defended.

Sure some defense attorneys are sleezy but most of the ones I know are dedicated to simply making sure the criminal justice system is fair and impartial and that the prosecutor and police are doing their jobs correctly.

It’s not about trying to get a guilty client off. It’s about making sure they get their day in court and that it’s a fair day. It’s an important and misunderstood job.

Yes, of course. The attorney is on your side and the more they know the better they can defend you. It's that simple.

Generally a criminal defense attorney does not ask whether the client “did it”.
A lawyer can’t let a client lie on the stand. Criminal defendants don’t have to testify themselves. There may be defenses which can be presented even if the defendant is known to have committed the act also. Greatly depends not he situation and each case.

Yes, you want to know. The job isn't to get a client off. !It's up to the prosecution to present an airtight case, if they don't, that's their fault, not yours as the defense. It's not whether or not they committed the crime, it's if the prosecution can prove it beyond a reasonable doubt.

Sleeziest profession is plaintiff attorney but criminal defense attorneys are their little brothers..
