I'm not saying it never happens but I'd wager it is extremely, extremely rare. There are too many sure fire liability cases to sink a bunch of money into a case where the client may be in the wrong.

If you caused the wreck, slamdunk no dispute, then no they won't. You need a defense attorney. PI take miney makers.

What about if you caused the wreck but didn't cause the injuries?

Nobody is found guilty in civil cases. The attorneys who represent the victim in the accident are plaintiff attorneys i.e. Gordon, Morris Bart,Dudley.

In civil cases the verdict is based on who was liable

Must be terrible for all the other states where they can’t just send someone to a chiropractor for a few months and demand policy limits. I bet they hate their lower insurance premiums, too.

There a ton of factors that go into Louisiana's insurance rates. 3rd world roads, low IQ drivers, tons of uninsured drivers, phone distractions, etc. Pinning high costs on attorneys is short sighted especially when you are offering jury trials over small damages as some kind of solution. Do you know how expensive(for the insured) and time consuming that would be?

Yep. More jury trials = more billables for the defense bar = higher insurance rates.

I think most attorneys who do PI work have handled cases where it is not an orthopedic or neuro case. Is this where you tell me all soft tissue cases are fraudulent?

Mo has over the years hired a stable of lawyers, some of whom can actually try cases. I was shocked myself, but finished one last year with a guy on the letterhead who did a decent job for his PoS client.

To the OP, TeeVee Lawyers only rep plaintiffs. Insurance companies would not hire them to handle defense cases. InsCos don't pay well enough for defense lawyers to advertise, and that isn't how you get the work.

Once the attorney knows how much insurance is available, he can send his client for enough treatment to force the insurance company to settle the claim to protect their insured. Rinse, repeat and we all pay sky high premiums on auto insurance and have to be bombarded with attorney advertisements as a result.



Would be interesting if limits were not discoverable.

I did it for a few years. Been out of that area of the law for a while. Is Dolmo v. Williams still the benchmark for soft tissue quantum? $2,500 per month of treatment?

Would also be interesting if there could be penalties for handling a third party claim in an arbitrary and capricious manner before the Claimant retained counsel.

Not really. The third party didn't buy the insurance.

I understand the legal argument. But if we’re trying holistic aporoaches to fix the system then that’s one I’d like to see.

yeah, that would outweigh the ending of the current auto-accident lottery system.

Just create a petit jury for claims from $20K to $50K. Limit jury selection to 2 hours, trial to 2 days. Saves everyone time and money.

Better still, prohibit lawyers from contributing to judicial campaigns.
