If the injuries are good enough, and there's a chance at a shitton of coverage (read: commercial vehicle), a lot of them will roll the dice and try to bullshite their way to a settlement.

Drop the threshold, extend prescription to 2 years, and mandatory recording of all calls with Claimant with penalties available for a&c handling of third party claim (with different standard than UM)

I know they passed something a few years ago where adverse party can extend prescription in writing, but I’m not trying to be the guinea pig on that one.

I am seeing more and more cases where all the attorney is doing is trying to set up a bad faith case when there isn't bad faith statutes. If you enact them, it will become a nightmare. Every accident will turn into a bad faith claim.

And maybe some adjusters and companies should get popped and put on notice that what they’re doing is bad faith.

i haven't seen much bad faith on the casualty side. Worker's comp is a different story, but what exactly do you think these evil adjusters are doing? Being dicks just gives you more business, but that isn't bad faith. if they do not want to pay a fair settlement plaintiffs can just go get a lawyer to handle it.

Mr. Smith is just tired of personal injury attorneys working cases up that have no merit, and is disappointed that certain doctors have sold their souls to personal injury attorneys. Mrs. Smith doesn't have to worry about what Mr. Smith makes, even if he did work for Geico.
