BATON ROUGE, La. (WAFB) - Prosecutors will seek upgraded first-degree rape charges against men arrested after an alleged sexual encounter with an LSU student before her death hours later. Stuart Theriot, a felony prosecutor for the East Baton Rouge District Attorney’s Office, revealed that information in bond hearings for the three men Tuesday, Jan. 24. He also added he plans to convene a grand jury in the case.
The suspects include Kaivon Deondre Washington, 18, who was charged with third-degree rape after allegedly having sex with the female student in the back of a car. Washington’s friend, Everette Lee, 28, of Pine Grove, was charged as principal to third-degree rape and was allegedly in the front seat of the car at the time. The driver, Casen Carver, 18, of Denham Springs, was also charged with principle to third-degree rape.
19th Judicial District Judge Brad Myers says prior to setting bond, he viewed video filmed by one of the suspects. He noted the video showed the suspects “callously” laughing as the young student slurred her words inside of the car, but does not show the assault. Myers says he also reviewed video from Reggie’s bar near LSU which showed the student stumbling, falling over, and needing help standing prior to the sexual encounter.
Defense lawyers hoped the videos would prove that the sexual encounter was consensual. Instead, Myers said the video combined by statements investigators say they obtained from Carver about the student’s behavior at the time was enough to convince him that a crime had occurred.

So they didn't film - or at least they may have deleted and there's a 'cloud search' underway the penetration. Or thath'd be video voyeurism.
Sounds like the defendant lawyer kinda messed up handing them evidence she was severely intoxicated and they laughed about it.
Upping it to first degree rape is a start.
Still need kidnapping and either manslaughter or negligent homicide.

To clarify, the affidavit says they found THC in a urine sample. So that doesn’t necessarily point to her smoking weed the night of the crime.
I’m speculating, but I doubt weed had anything to do with it. Plenty of college girls smoke casually nowadays (not that there’s anything wrong with that, IMO). I don’t think it really matters though - at that BAC she’s already blackout drunk regardless.

They should have no problem convicting them on just the circumstances, BAC testing and DNA alone. If the white guy that drove the truck decides to further rat out the black boy and juvenile who raped the girl it will just be icing on the cake. Uncle Lee may try and stay out of it as much as he can but will still be just as guilty for his part.

Nancy Grace will be covering this story. This story is going to become a BIG DEAL to the entire nation and probably make history. Has everyone talking. Beautiful college age girl victim, and has ignited discussions on racism, sexism, rape, very unusual chain of circumstances. The national media will beat this story like a dead horse. We will never hear the end of this, and may not want too.

In loco parentis ended in the 1960s. LSU has no control and very little influence over what students do off campus on their own time. The university will probably double down on safety awareness and students will probably heed it for a little while. But this isn't the first such incident and sadly it won't be the last.
Ironically, by pushing alcohol off campus, LSU made students less safe. If these kids had gone to a university sanctioned keg party with adult supervision and no outsiders, everybody has 3-4 beers and goes home to live another day.

Seems like there is only 2 explanations here. 1: she was raped by those guys and kicked out the car when they were finished with her. Supposedly there is video evidence to prove thats not what happened. Or 2: she was the type that liked to party and have a train run on her. It's sad that a girl of 19 years old is gone way to early. Either scenario doesn't help the family get over her death.

Re:2. That only happens in the fictional porn universe. Might there be some chick, somewhere among the 7 billion people on earth who likes to get blackout drunk and have gangbangs with strangers? Maybe, but if some defense lawyer raises that possibility while I'm on the jury it will be difficult verging on impossible to get it past my bullshite meter. Not only that, every other point he raises will immediately be suspect.
