Technically, no.
Family of victim is usually consulted as D.A. doesn't want them out to the media complaining about D.A.'s actions.
D.A.s are elected. So family is told, "Here's the situation..." We can do X or we can do Y. Here is how X would go. How Y could go...
Madison's family would consider risk of jury doing something crazy, a trial with all the video and stress, and for some of the defendants they might think some more culpable than others.
Madison is dead and nothing they can do about that. It's a question of responsibility and that is played out in terms of years and consequences for the perps at this point.
Most defendants take a deal. But some don't.

Considering this is the 'main thread' thought I'd repost what "Judge" pointed out.
This law may come into effect for Washington:
This law may come into effect for Washington:
quote:
CHAPTER 3. HABITUAL OFFENDER LAW
§529.1. Sentences for second and subsequent offenses; certificate of warden or clerk of court in the state of Louisiana as evidence
A. Any person who, after having been convicted within this state of a felony, or who, after having been convicted under the laws of any other state or of the United States, or any foreign government of a crime which, if committed in this state would be a felony, thereafter commits any subsequent felony within this state, upon conviction of said felony, shall be punished as follows:
(1) If the second felony is such that upon a first conviction the offender would be punishable by imprisonment for any term less than his natural life, then the sentence to imprisonment shall be for a determinate term not less than one-third the longest term and not more than twice the longest term prescribed for a first conviction.
(2)(a) If the second felony and the prior felony are sex offenses as defined in R.S. 15:541, or the prior felony would be a sex offense as defined in R.S. 15:541, except it occurred prior to June 18, 1992, or the conviction was obtained under the laws of any other state, the United States, or any foreign government, the person shall be sentenced to imprisonment at hard labor for a determinate term not less than two-thirds of the longest possible sentence for the conviction and not more than three times the longest possible sentence prescribed for a first conviction, without benefit of probation, parole, or suspension of sentence.

I’d say four or five, but point taken. I’ll step back. It’s all yours.
No need for you to step back. I don’t think that was aimed at you in the same way it was with Hodsontiger. There’s a HUGE difference in y’all’s posts.

Hearing the 17 yo is getting out today, also he has another incident on his record. Anybody else?
Posted on 2/15/23 at 12:25 pm to Tigerpaw123
Getting out?
All four bonded out at one point but then Washington (he's 18) was arrested on another charge in Livingston (raping 12 y.o.) and then just yesterday charged again in EBR.
Grand jury started up today to see if the 3rd degree rape will be only charge or if they'll include other charges / more severe charges as well.

Explain this for the class, please.

I'd be shocked if an indictment doesn't come down in this case, unless the DA doesn't want to deal with the case because of "reasons". A friend familiar with these proceedings once told me that a half decent attorney could probably get a grand jury to indict a ham sandwich without much of a problem.

There will be indictments. It won't be as big of a production as Hodson has been cosplaying for, though.

You are friends with Judge Sol Wachtler?

Not, but I am sure that's who he stole that from.

I do not think that is correct, all 3 adults initially bonded out but the juveniles hearing was delayed to February, and I am hearing that was yesterday or today, but not sure

yes, one of the accused has since been arrested and booked for the rape of a 12 year old (happened a few years ago) and then again has been charged with a third rape (happened a few months ago)

I don't remember the exact date, but it was about 3 years ago. She was 12 and he was around 15 (conflicting reports on his age). But however old he was then, it's a bad look to be arrested for 3 separate rape incidents by the time you're 18.
I believe in "innocent until proven guilty" and everyone is entitled to a fair trial, but this guy is either a serial predator or the unluckiest teenager on the planet. My money, if I were a gambling man, would be on predator. He needs to be taken out of circulation.

Prosecution can "bitch" Washington. Stakes higher in each of the subsequent cases.

i thought i had heard originally his arraignment was a lot later than the others bc of juvenile court backups??? i could be wrong.

IIRC, they have thirty days from initial arrest to charge him as an adult if they are going to do so.

I think obvious alter, shill accounts, or accounts who clearly have multiple users running them violate the TOS for a start.
If it’s up to me to RA then I can do that.
ETA: RA’d user in question. Ball in your court.
