After his conviction, which is why the statute says, "after being convicted...thereafter commits any subsequent felony within this state".
He hasn't been convicted of any felonies yet, so any of his past behavior shouldn't be subject to the habitual offender statute.
It probably won't matter given the nature of his charges and the jurisdictions (if he's convicted he'll get life for the 1st degree rapes), but, at best, he'd be a 3-time felon if he ever was released and could be bitched after that (which could get him life).

Seems like the majority of people are convinced of the guys’ guilt here.
Question: Does anyone have the BAC of the males involved?
If the sex was indeed consensual, I think it’s very important to know if all parties were above the “legal” limit.

No, because they didn't take Madison to the sheriff substation about 1/2 a mile a way and get tested.
Instead they dumped her off in the rain because they'd already got their rocks off - leaving her to be killed by a passing car.
Doesn't matter what their BAC is because the law says what a "REASONABLE PERSON" would conclude about Madison (the victim's) condition.
Not 'what a drunk horny teenager rapist' would conclude...
