Her being dead likely made this a case to begin with. That’s not a new opinion or a radical one. Her death set the investigation in motion. But we can’t say for certain that she wouldn’t have gone to the police either. We will never know. Her death is also benefitting the defense because now we can’t talk to Miss Brooks about what she remembers (or more importantly doesn’t remember).

He's not saying 'unreported date rape' but that's what he means. Let's be honest.

LP is now likely working on getting even more of the serial rapist victims cases together. From what the victim said, a few of her friends were also raped by Washington. It`ll be good to get a few more nails in his coffin.

Not to mention there's a good reason alot of people don't have completely spontaneous anal sex. Sometimes you end up with quite a "mess", for the lack of a better term, if the female is not fully prepared for it.

I was only responding to the first part where you said he meant that it would be an unreported date rape. Pretty awful defense attorney to say it's only date rape (and not "real" rape) if she didn't die.
I took it to mean that she would never have complained because she was fine with it.

I’ve thought about this but did not want to bring it up. Joe Rogan has made some pretty blunt comments on this point.
Relatedly, if the sex was violent, there will be blood. I wonder if they’ve tested the car.
It would be hard to argue she consented to that kind of sex.
I’ve refrained from discussing this because it is distasteful. But it might matter.

I think of a guy is that drunk, he is not going to have the physical capacity for sex. He could still be assaulted though, I guess. And not many people would believe him.

i recall you touching the subject lightly but you are right. this is a critical piece for the prosecution. completely defies what even the kinkiest among us accept as a realistic scenario.

I think you mentioned earlier today that the "injuries" might come into play, and that's what I figured you meant. A drunk girls butt, excuse the crudeness of it, isn't exactly conducive to spontaneous sex. Especially if that wasn't a regular thing for her. I believe a report came out saying the findings were consistent with sexual assault, right?
