They wrote the statute this way for a reason. They could have said drunk sex is rape. (Many of us would not be alive but for drunk sex.)
Under the statute, you have to reach incapacity levels. And it has to be apparent that you were incapacitated, not just that you were very drunk.

I've read them. Truly sad is how the comments are 99% divided by race. It's not even about the rape...its a black vs white issue.
There is no way in hell I'd be defending any of the rapists if they were white.
Even more sad, they are so caught up with black victimhood of the rapist that they are victim blaming even in the LP rape case where the victim is black (not sure many of them realize it yet, or if it would even matter)

I agree in a jury trial there is no such thing a a slam dunk case. The jurors are a huge variable
But when I see that video of her feet dragging and know that probably 15 minutes later there may a video where she says sure in a terribly slurred voice and then she gets a train run on her

The investigators did a good job getting the perps to admit how drunk they believed Madison to be. (Slumped over, DRUNK drunk, etc.)
.319 would seem to qualify as 'stupor' level drunk.
But it is a good point that burden to prove it is on prosecutors.

The clinch fact for me is the way she died. If she’s too drunk to stay off Burbank, she’s too drunk to consent.
The Uber driver’s testimony may become important here. Did she run into the street? Fall in front of him?
How incapacitated she was then will bear on the question of how incapacitated she was during sex.

Washington admitted that she was very drunk. He said she was "not just drunk, but drunk drunk." Plus, the 17 year old knew because he helped her off the floor in the video from Reggie's. Even the driver said he "hated" what was happening in the back seat.
It will be interesting to see what "Dr." Lee has to say about the evening. It seems at least 3 were very aware of her level of intoxication.

And as the dad of three daughters, if that were my kid and they escaped justice …I’m smart enough to play the long game, sometime over the next 10-15 years each perp would suffer some sort of life ending accident and in the most painful way possible
