I was thinking this one is such an obvious prosecution and obvious crime that if the media was smart they would do the opposite of what they have been doing. Then they can say they don’t have an agenda. We are only going to hear about Memphis for now then they will move south for this.

This comes down to one question: was Madison Brooks capable of giving consent?
And the law is very clear that she could not

Yeah, I don’t know what’s the best scenario here, but this info being out there is really unfortunate
It is. It’s also a continued education process that is important to continue talking to our kids both boys and girls about every aspect of these events and help then learn and understand all things at play.

Has there even been much noise on that since the pics of the police officers came out?

Wow. That’s a good one. Can you think of anything maybe above middle school name calling
You aren't worth more than that.

Yea, blame the bars and not the fricking rapists. Didn't realize president Tate was a poster here.

only the video that was presented did not show the assault.
Exactly. Doesn't mean the perps didn't have other video or the video presented wasn't edited.
The didn't expect to be defendants one day for this. Likely they did video the actual rape and DA's office is in the process of getting that video from devices, iCloud, etc.

Wonder if this is the first case assigned to Brad. What a doozy to start with.

Weird take on the situation. I'd think you'd need to call more national attention to retarded fricks who rape drunk chicks.

I blame whomever she went to the bar with that night. I hope they read this. The blood is on YOUR hands too.
Get out of here with that bullshite.

Exactly.
Most damning piece (well, all of it was) from the affidavit (see page 1 of this thread) was when asked where she lived she couldn't answer them. She slumped over half passed out.
So what did they do? Drove 2 minutes to park and rape her.
They knew she lacked capacity but did it anyway.
The defense lawyer just gave evidence verifying she was extremely intoxicated and told the DA's office: "Hey, go get the rest of the video off of these phones!"
Which they will....

Ridiculous take is ridiculous. You have no idea who she went there with or how she ended up alone. Who's to say she didn't wander off for a minute, which is more than enough time for these predators to have made their move.

I'll preface this with, I hope these guys burn in hell..
However, we have the luxury of knowing her BAC after the fact. The defense will surely say the evildoers had no way of knowing that she was unable to give consent. The will find an expert to testify of the different effects alcohol has on different people and that someone with a BAC of .08 can exhibit behaviors much like the stumbling and falling down the victim exhibited.
Many laws are based on the word "reasonable".. The judge can back me up on this. However, there's really no definition of reasonable in that context. It's left to each jury member to decide.
I can also see the defense claiming that the evildoers were just as intoxicated and unable to make a reasonable judgement on consent. Remember, the arrest warrant specifically mentions this poor girl gave consent multiple times, for whatever that is worth now, knowing what we know now in that she was unable to.
I'll say again, these frickers should die, but a good defense and a couple of unreasonable jurors can cause a mistrial with a hung jury.
Just trying to be real and leave emotion out of it.

You know what's telling? They didn't know this girl. Someone convinced the drunk girl to get in the car. Someone physically helped the drunk girl get into the car. They likely wouldn't have ever known her name. They didn't know where she lived. They didn't know anything about her, except that she was drunk and falling down. No one in that car was "her boyfriend."
This is a classic criminal act. A random opportunity kidnap, rape and dump.

The driver already told the cops he knew it what was happening was wrong

At over .30 bac, I doubt that will hold much water.
A small young female would be absolutely blitzed at this level of intoxication.

According to the WAFB Facebook page, some LSU Freshman has started a free rideshare app. To avoid this in the future I suppose.

Don't really see how that helps in a case like this.
