Explain to me how past sexual encounters have anything to do with whether or not a rape occurred.

Yeah, my opinion about that law is probably not relevant to this particular case. I just think it's an awful law.

How else would you write that law?

Why though? There is no logical reason for someone's past to have any relevance to whether a rape occurred.

Beyond that, I am sorry but a victim's past sexual conduct seems extremely relevant to a rape case
You can be the biggest whore west of the Mississippi River but that doesn’t matter in a rape case.
Playing the “she’s a whore, so she definitely wanted it,” isn’t the best defense.
This isn’t Opposite Day in elementary school where no means yes

Will decide what is allowed into evidence based on the Code of Evidence.
You should read article 412 of the Code of Evidence

Oh look, the race baiter dickweed lawyer was dead wrong and made it even worse for these thugs.
Epic miscalculation. In fact, since the men are seen "callously laughing" on the video, it will nullify any defense claim of "Oh but I was drunk too". They knew exactly what they were doing.

It's incredible how you take the idiot standpoint in every thread.
Unless you are, in fact, an idiot 24/7.

Really makes you scared if your fate ever came down to a jury.
Most people who try a lot of jury trials would tell you they would always ask for a jury if accused of a crime.

I'd imagine there are warrants for the 'Cloud' and an examination of the phones in the vehicle.
The perps didn't record any of the actual rape/sex act? Find that difficult to believe. They likely recorded and then deleted it but it'd still be found.
Two of the defendants have bonded out per WAFB.

With this increased charge will the jury be able to consider lesser charges if it finds 1st degree level of evidence was not met?

ZERO % chance they didn't record the sex and share at least amongst themselves.

Two have bonded out:
BATON ROUGE, La. (WAFB) - Two of the men accused of participating in or witnessing a sexual encounter involving an LSU student before her death bonded out of prison, according to records from the East Baton Rouge Parish Sheriff’s Office.
Everett Lee, 28, and Casen Carver, 18, bonded out of jail on Tuesday, Jan. 24, according to their attorneys.
The men appeared before 19th Judicial District Judge Brad Myers earlier that day to determine their pre-trial bond amounts.
Lee’s bond was set at $75,000, and Carver’s bond was set at $50,000, records show.

Just curious, were any charges ever filed against whomever was driving the vehicle that hit Madison?
