There's absolutely no way 11 people are on the defenses side.

I mean the prosecution wants the 1 juror to stay and the defense wants the 1 juror to leave

For whatever reason they obviously both think the other 11 are voting not guilty for insanity

Apparently the prosecution agrees though

There's really no way of knowing. I think Red is just shooting his shot and is ready for this to be done with. I think if this were to go the mistrial route, Lindsay is gonna be hammered way more than she was in this one to really drive the point home that she's responsible. Obviously not a lawyer, so I could be way off base.

Is it possible that the others agreed to a lesser charge and the one is holding out for full first degree murder? Kind of a middle ground and not straight up NGRI.

I mean if I was the prosecution I would have let that juror walk and take my chances

If they truly believe she is definitively guilty all another trial would do is give them a chance to frame the case in a better way. The defense can't do anything differently really, the prosecution can.

Sure seems they are leaning NGRI

As much as it sucks, the prosecution was so bad I think that’s the “right” verdict according to Mass law

The law sucks and the penalty sucks worse. You should still face life outside of Gen pop even if you were insane .

Clancy’s defense attorney insinuates there is a lone juror who is holding out and refusing to find Clancy not guilty.

Again, how on Earth could he possibly know this? He also didn't say anything like that so that tweet is just clickbait nonsense, but that's another topic

In Karen Read's first trial, Auntie Bev declared a mistrial even though they were unaniumus on all the major charges.

Honestly, if the hang up is the definition of reasonable doubt, it's more likely that it's a holdout that is refusing to convict clinging to ANY doubt

Of course they don’t “know”, but when the actions of both the prosecution and defense point towards the same thing, well….

Give me a simple explanation how the frick he would know that though. You can't do it.

They read jurors and the like for a living. He doesn’t know but he clearly feels that way and it’s clear the prosecution feels that way too

Literally all you needed to say. He's guessing. Logically speaking one person holding out of reasonable doubt points to one dummy thinking any doubt is reasonable doubt. But Red knows this jury is going to be the best shot he will get at a favorable outcome for his client, so he's pushing to get it done now instead of a mistrial.
