The death penalty might be effective if people didn’t stay on it for over 25 years while their appeals are heard.

Remember Scott Peterson? Still alive.

This is nothing but grandstanding by a politician.

SCOTUS is not the final answer on cruel and unusual. If enough states do this, the definition is changed.

Does the death of a soul count? Unfortunately that is the result of some of these.

I did an interview for ABC News before the Kennedy ruling. There is a clip of (Fat) me and my Dad walking down the sidewalk.

Is that accurate? I think treason is punishable by death, so I wonder how to square that with the idea that the death penalty is reserved for crimes in which someone is killed.

See

quote:

Our concern here is limited to crimes against individual persons. We do not address, for example, crimes defining and punishing treason, espionage, terrorism, and drug kingpin activity, which are offenses against the State. As it relates to crimes against individuals, though, the death penalty should not be expanded to instances where the victim’s life was not taken.

In this case, the overturning of that ruling.

Kennedy v Louisiana was a 5-4 decision, so definitely not out of the realm possibility.

Well, to be fair to that poster the opinion in Kennedy was heavily based upon the notion of a national consensus against death for a child rapist...
quote:

The existence of objective indicia of consensus against making a crime punishable by death was a relevant concern in Roper, Atkins, Coker, and Enmund, and we follow the approach of those cases here
quote:

The evidence of a national consensus with respect to the death penalty for child rapists, as with respect to juveniles, mentally retarded offenders, and vicarious felony murderers, shows divided opinion but, on balance, an opinion against it
quote:

These concerns overlook the meaning and full substance of the established proposition that the Eighth Amendment is defined by “the evolving standards of decency that mark the progress of a maturing society.”...The rule of evolving standards of decency with specific marks on the way to full progress and mature judgment means that resort to the penalty must be reserved for the worst of crimes

You don't want to read the internal damage that monster did to the child. The USSC majority are blockheads in this case

Not looking to debate the issue here, but for the other side of the argument, the CEO of STAR wrote a lengthy article recently in opposition to Louisiana moving back in that direction: LINK

Correct, the Supreme Court already ruled on this. Louisiana had the death penalty for child rape up until that ruling, was around 25 years ago.

Let's see what this court thinks.
