Kennedy v Louisiana was a 5-4 decision, so definitely not out of the realm possibility.

By the time it reaches the Supreme Court again...all the current Justice's will have been dead at least 10 years.

Either a lot of people are planning to move out of state or they had better build a new wing on death row. Either way, the population of Alabama is going to get a lot smaller.

This has been played out in Louisiana for decades. If the Supreme Court ever rules it constitutional, the state law for the death penalty is automatically enacted. It isn’t happened yet, as much as I wish it would. People can say what they wish and be as emotional as they want. History is history and constitutionality is what it is. I’d love to have it happen.

I remember back in 2022 when Alabama made abortion illegal. Everybody said it's unconstitutional. Well it's 2026 and abortion is illegal in Alabama .

Can only give the death penalty for someone's death

Oh!
Well that sounds like "an eye for an eye".
And in that case....

It's an odd reaction to immediately call it unconstitutional. You also didn't deny you're a pedo. Hopefully you aren't actually a coach

Why is it odd to state a fact? It is unconstitutional until the Supreme Court overrides its own precedent.

In anticipation of the judicial action that made it happen. They weren't just lucky, dumbass

The only thing odd was them attacking him for stating a fact. Some think they get virtue points like we all here aren't against such acts.

Death is an easy way out anyway, they should bring Asian caning in.

Alabamans are celebrating the cutoff at 12. There's a shitload of college freshmen who'd have their asses on death row!

Unconstitutional

First of all I’m amazed that a completely legally correct assessment of the law received accusations of being a pedo not that amazed but still.

Second, you’re correct, but I wonder how durable that is. I am staunchly opposed to the death penalty but I tend to think SCOTUS’s Eighth Amendment cases don’t have a lot of objective backing. The two broad schools of thought:

• Original intent / what it meant in the 1780s—really hard to argue executing child rapists is contrary to this when rapists of any kind could have been executed for their crimes as recently as the 1970s.

• Living document / what it means today—pretty sure for better or worse that most Americans have no problem with executing child rapists lol. I don’t really think SCOTUS should make itself the arbiter of what is morally acceptable in today’s society anyway, but even aside from that, I just don’t think the average person thinks executing child rapists is cruel or unusual at all.

My guy it is 10x odder to assume someone correctly stating the law is a pedo than it is for someone to correctly state the law. Maybe 100x odder. Braindead take.

I'd like to see Alabama's list of convicted child rapists.

I bet the number of Muslims is minimal compared to the number of teachers, Catholic priests, Protestant youth ministers and dirty old man grandpas who couldn't keep their hands of their own grandchildren.
