Non-premeditated murder, but intent to kill...should have left it at 3 unless there’s evidence out there not being made public.

I don't know how MN law works, but in many states, I believe he can still be convicted of the lower charge if the prosecutor fails on the 2nd degree charge.

If they overcharge can they get him on a lesser charge? Because that one might be tougher to prove.

They’re going to try and prove Intent to Cause Bodily Harm I suppose. That’s tough considering those tactics were in the Police training manual.

It all depends what options are presented to a jury. They won't be able to just throw every charge at them hoping something sticks.
