got an attorney and claimed injury. I know it's not technically "being sued" in the literal sense. Hiring an attorney is for getting max money out of accidents, because most of the times insurance companies just settle.

For us non-lawyer types, we call it sued.

I'm in the same situation.

My wife was hit 2 weeks ago. About 3500 in damages, no injuries that we are aware of.

State Farm is the other party's insurance.

Claim adjuster told me they are "investigating" fault because their insured is disputing the ticket and police report.

Told the adjuster we have been driving a damaged vehicle for 2 weeks and they can either provide a rental by Friday or get sued.

The adjuster said have a nice day and hung up.

Looking forward to collecting $25k from those jack nuts.

It took 3 months before I was finally able to get my jeep repaired after the accident I was in last year(thank goodness the damage was purely cosmetic...busted up front bumper). 5 cars involved....the guy who caused the entire accident wouldn't answer his phone from his insurance for over a month. Got similar type answers from his insurance as well about needing to speak to him first and can't just use police report. Only reason I didn't just pay my deductible and go through my insurance was I didn't have rental car coverage at the time and didn't want to pay for a rental car myself while my jeep was in the shop.



Lesson learned, always have rental coverage and next time will file through my insurance and let them do what I pay them to do and then get reimbursed for my deductible later.

The "pay day" mentality... This is why Auto insurance in La. is an abomination... you have liability only and you expect the other guy to pay without an investigation.

If you do have full coverage plus rental then call your insurance. This is why you have insurance!!! If the other driver is found at fault, your insurance will subrogate against the other insurance and you will not be "dinged" on your record.

If you are wronged during the process then by all means take it out on them but otherwise there is a process where you will be indemnified of your damages.

not sure what city your accident happened, but BRPD accident reports are available 3 days after the accident.

Make sure you file for depreciation of your car being in a wreck. A lawyer once told me that if you are in a wreck the value of your vehicle goes down when you try to trade it in or sell it. Insurance needs to pay for the loss of value of your vehicle.

That was the first mistake. Call your insurance and have them do the work for you. They also can't be bluffed or be lied to since that's their business.

You could have been reimbursed for the rental as well if you paid it out of pocket. I completely understand not wanting to pay anything if you aren't at fault either.

I had an accident that totaled my truck. Wasn't my fault,after 3 days of trying to deal with Liberty Mutual I handed it over to my insurance to handle. I don't have the energy to chase down L.M. and have to listen to their BS.

Yeah I figured that as well. A huge part of it was that we had just come back from a vacation so money was a lil tighter than usual when the accident happened. Add in Christmas being not too far away and I just didn't want to shell out any of my own money and wait to be reimbursed for it. I never thought it would take 3 months to get it fixed. If it would have been damages that prevented me from driving it I would have likely just filed with my insurance.

thank you for clarifying that for the lawyer.

i'm just tired of paying the higher insurance rates in LA b/c of the sue happy people. Given the opportunity again, i'm getting my money. After i get it, i might donate it all to a commercial to say how much pieces of shite people, like myself in this instance, are for taking advantage of a flawed system and that we need to quit being so god damned sue happy. Quit trying to make others pay for the failures in your life.

I called my insurance first. They said to go through his insurance unless they gave me any issues.

I was in a bad accident in the past that left me in the hospital overnight. I received the run around from insurance and had to lawyer up. It's not fun, it's scummy feeling at some points, and it takes forever. I already have an estimate and it's around $1000. Not worth it for this kind of case.

If the at-fault driver didn't admit liability within the police report, or to someone with the insurance company, the insurance company will likely investigate without an admission. The police report, even the fact that citations may have been issued, doesn't prove fault on its own.

He admitted fault at the scene. Don't know if it is captured in the report though.

This all happened in Houston BTW.

What's bad is a while back I was rear ended by the crack head looking white dude. Gave me some sob story about how he takes care of his kids, but his wife still collected child support and they took his license since he thought he didn't have to pay now that he had them blah blah blah. I was young and stupid and didn't call the cops since it wasn't really bad. Took his info and the guy had cash in my hand within like 4 days.

A crackhead behind on his child support and driving without an expired license is more trustworthy and responsible than an insurance company

I've had two opportunities were i could have gotten money from an accident and acted like a normal human being and didn't b/c i wasn't hurt. I've since had two dipshits walk away from accidents that they had zero damage to their cars yet somehow managed to walk away with over $50k each.

I used to think if we all had my mindset and didn't sue every time someone bumped into us, maybe our insurance rates would go down, but i've come to realize my efforts to be a good citizen are useless, and if all these other pieces of shite are going to get money while we all pay high insurance premiums, then i'm going to get the money too when given the opportunity. If the system is set up to pay out so easily, then i might as well take advantage of it. I'm paying for it anyway.
