So what you are saying is I have to have my insurance intimidate his insurance if he says he's not at fault. Because all their investigation is there for is to see if they are responsible if it comes to a lawsuit.

They should, if they cared about you. you shouldn't have to do much of anything to your insurance. They should be smart enough and experienced enough to handle this in a timely and professional matter. Who's the insurer?
I know the last time i was in an accident, which wasn't my fault, my insurance, Geico, got me a rental and fixed my car at no charge to me b/c they knew they would get reimbursed from the at fault guys insurance. They didn't even ask me to pay the deductible first, just said they'd take care of it. I have zero complaints with Geico.

If you do have full coverage plus rental then call your insurance. This is why you have insurance!!! If the other driver is found at fault, your insurance will subrogate against the other insurance and you will not be "dinged" on your record.
If you are wronged during the process then by all means take it out on them but otherwise there is a process where you will be indemnified of your damages.

Good stuff, came on here to see what info I could gather before I blew off some steam while talking to the other party's insurance.
This hipster chick rear-ended me (while I was stopped at a red light) in her VW Beetle. This happened on Monday morning and I filed a claim with my carrier, GEICO, within an hour who in-turn called her carrier (State Farm) to establish a claim. As of this afternoon, State Farm has not been able to reach her. I have her cell and have spoken once and exchanged a few texts, but now she will not reply or answer.
Here is what State Farm said:
1. They will call her 4 times, with a limit of once every 48 hours
2. If they don't talk to her during that period, their "claims" department turns it over to the "property" department who, I was told, will call every day and will call until they have an answer....and even will knock on their door.
ya right....
All in all, I have a bad feeling about this. Perhaps the silver lining is that I took 30+ pictures and some video before we moved the cars to the side of the road. They show both cars, in positions right after the accident, shows her in the picture in case she claims she wasn't at the scene. Pics of her drivers license, license plates, inspection stickers (expired by almost 2 years), all sorts of stuff that I sent over to State Farm. It is painfully obvious what happened.

Don't start to believe that evidence will help.
My buddies daughter rear-ended a well known LSU athlete last year. There was no damage to the vehicles at all. This gifted NCAA athlete filed a claim for "permanent disability" and "loss of enjoyment of life." The attorneys and insurance were provided ESPN videos of her right after the accident and months later competing at an elite level doing all kinds of strenuous activities but that doesn't matter. They are still pushing forward with paying her off. Such bullshite. Guess who is going to be holding the bag with higher premiums? You and me.

OP, they basically have to verify their insured was even in a wreck. Same thing happened to me. They had to wait until their insured made bail. Then they quickly accepted liability.

Get the accident report.
Take it to Calvin's and get an estimate for repair.
Send it to them and, contrary to what the dumbass TV lawyers tell you, give a recorded statement.
If they don't make a written offer to settle within 30 days of your giving them all of this, you can go after them for bad faith (punitive damages and attorney's fees).

How common is it for your own insurance company to fight you on a$200 supplemental when they already know the other insurance company is paying the whole thing?
I'm canceling Safeco asap.
The supplemental was for an alignment, BTW.

We've had mostly good things w safeco, there's maybe been one thing a time or two we've had to fight for insured and take it up the ladder to eventually get done. Ask agent to intervene and make some calls. I wouldn't cancel safeco cause of it. Auto market kind of sucks and just keep at it w them, don't take no.

I mean, I can see where they're coming from. And just bc the other company is ultimately responsible, they may not pay for it either.
However, I doubt $200 would bankrupt the company so I don't see why they wouldn't give you the benefit of the doubt and pay for it.
