Can you FOIA a School's Camera

Had a meeting today because on Friday a teacher went off on my kid. It was confirmed that it happened and she apologized so I left it at that. Im not one to cancel someone over one thing if they own up and fix it.

During the meeting though, I did notice her husband waiting outside of the office for her. He is an administrator in another building. Wife thinks that she had her phone out in our meeting and it may have been on. Its odd that I requested the superintendent to be there, he cant but a principal at another building can randomly be there as she leaves. Its a small district and both her husband and him work in the same office.

I dont even know if I would go forward but something just doesnt feel right about this.

Or they wont give it to me or say theres no record because the FOIA rep is the superintendent and his assistant.

What are you hoping to see on the cameras? What is the significance of her phone being out or her spouse being nearby? Were the issues resolved in your meeting?

If the husband had their personal phone out recording then you can't nor will it do you any good.

Depends on what state you’re in. If you’re in Arkansas, it is legal to record conversations. One-party consent state.

I get some parents are crazy so maybe he was thinking he was protective or something. Im just interested if he was because if it was her it is illegal. How I could prove that, no idea and likely wont.

Just disappoints me further I suppose

IL - closed door meeting. He would have been in a hallway. Principal, Teacher & us.

I get teachers and everyone has bad days. I just want to ensure it doesnt happen again and im not being played here because it just doesnt seem right.

It would be both personal phones and yeah id look like a loon if I went further. Well aware.

Which part was illegal? I’m trying to understand the situation. Are you in a 2 party consent state and think she was recording? Or had him listening through a phone call? Louisiana is one party consent, so I’m not sure it would be illegal here.

If that happened, it sounds to me they would have likely been attempting to protect themselves from any further allegation. CYA of sorts to prevent a he said/she said from escalating and to have a clear record of what was said.

Whether that was legal or not is whole different convo. I don’t think you have much to worry about though, unless you were being an unreasonable a-hole or making threats.

He was probably waiting because she was scared. She shouldn’t have been, but she was and she asked him to be there.

Can you FOIA school cameras? It’s a good question. Government offices that record are producing a record. If the government produces the record, it must be available to the public (unless its in a restricted area maybe). Are schools the same thing as a government service? I would think so, huh?

The school is technically restricted access. And you’re dealing with kids. So there may be some cause that doesn’t let you see videos.

If it wasn’t being recorded, I’m not sure it breaks any rules - even in a two-party consent state. Maybe someone else can chime in on that.

Not once was it ever escalated. It was confirmed, I said I wont put a complaint in if she said sorry and to learn from it.

It was weird when I saw him then my wife was the one who brought it up a bit ago. I did see her messing with her phone at the beginning of the meeting to where it did catch my eye but thought nothing of it at the time.

So you can record any conversation you are having with another person as long as they know they are having the conversation with you. They don’t have to know it’s recording.

You cannot put a recorder in a room that you are not in to hear what’s being said because you are not part of the conversation.

I don’t know if having some listen in would be the same as recording the conversation you are in. The person listening in is NOT part of the conversation, but the person who has the phone on is part of it. It’s an interesting question.

Yes you can. FOIA equivalent requests for schools get their attention real quick.
