This analysis isn't going to firm up much of anything, Boosie. I worked both sides - just under 3 defense, about 7 plaintiff and then a year or so of general practice before I got off the treadmill.

Defense can't screen their cases - so their perspective is always going to be jaded - if they have a bread and butter client like Allstate, Geico, Liberty Mutual - etc. - they're going to get every trash case filed by starving attorneys in city court, parish court - wherever they can afford to get it filed and pray.

And the judges don't help because a good portion of them concern themselves with how the plaintiff's attorney is going to get paid or how the plaintiff is going to pay his/her medical bills, rather than consider actual liability, as most of them were plaintiff attorneys themselves.

On the other hand, as a plaintiff lawyer, I was always in a position to believe my client - you have no other way to operate than that - many pure defense guys never get that. So, if there is medical treatment, medical reports, whatever, I would make the argument for compensation. If liability was arguable, I would make the best case I could. Some plaintiff lawyers are just too hungry to screen cases like that - so they put up a broader, shallower net and some of those are going to look fraudulent to the put upon defense firm associate (or partner) who has to "take out the trash" so to speak.

But, honestly, out and out "fraud"? That was extremely rare - I worked a couple (no more than 6) on the defense side, and I had a single mediation where the defense had some pretty damning video of the client doing a bunch of shite he said he couldn't do at the deposition.

But, that was out of, maybe 850 to 1000 litigation files I worked - call it 1 percent.

Now, if you count exaggeration and "case building" activities as "fraud" - then it has to be in the 90s - and I just disagree - it's an adversarial relationship based on principles of negotiation. I never made false or misleading representations to the court or to the other side. "Spin" isn't "fraud."


(ETA: And I don't want to have this disintegrate into a discussion of the mills - yes there are firms that use runners, yes some larger firms "work" their bad cases trying to make lemonade. At some point, it's malpractice if you don't advise your client to get medically evaluated in the context of proving up a claim. On the other hand, sending all clients to the same doctor who produces the same report (to the extent of not changing pronouns, frick a gender, right?) is frightfully sketchy.
