Just because the guy was accused, doesn't mean he IS guilty.

Couldn't agree more. I'll admit I'm a bit biased when someone is actually indicted, but the original accusation/arrest should be taken with a grain of salt these days.

The woman told police after they met on the social media app, they agreed to meet in person at her apartment.

When Jacob Hirsch Witz arrived, the initial police reports say they sat on the couch and talked a while and moved to the bedroom to talk. The woman's statement to police says Witz became suddenly aggressive and pulled her shorts off. She goes on to say that he slapped her across the face, ripped off her shirt and bra and raped her as she begged him to stop.

The police report says Witz then found the woman's phone and forced her to unlock it so he could delete all text messages between them. He then forced her to take a bath while he watched. The woman told police Witz said "Pretend this did not happen. Don't tell anybody. I did not rape you, I got to get out of here."

I love how the story laid out her side of events without saying anything about his version of what happened.

Also, I'd like to see what evidence was presented at trial to support her accusation of rape against him.

Point being based on your previous comment, I think most on the OT agree, is that this guys life is ruined by a Google search by HR for any job he ever applies for. Forever.

VS a girls name whom is never revealed.

In their defense, the guy took Five and peaced out. He gave no public version. Now that it's over, maybe we will hear his side.

Well what is your solution? Not guilty verdicts mean the accuser will be revealed?

C'mon. That does nothing to discourage those who lied. The only people that are really affected by that are legitimate victims. It isn't nearly as embarrassing to be revealed as the person who lied about rape as it is to be someone who was truly raped.

I knew the defendant for a time and I have to admit I wasn't shocked at the accusation. But he obviously wasn't proven guilty in a fair trial so that's that. I would love reading more details about the trial.

He took a masterful approach to his defense, not saying a damn word to the police, letting his attorneys (who were probably the best money could buy) speak to his innocence, etc

I don't understand why he would force her to delete her texts earlier in the evening.

Did she specifically state, "you can come over, but no sex"??

or were the messages hella suggestive on her part, and she knew they would make her case hard to prove?

So, you think it's better to hide the accusers name, no matter the verdict? So society can continue to smear men's names across the media with no repercussion to the accuser?

You need to rethink your logic.

Ether keep both parties names sealed, or revea both. Obviously it's slanted against the accused the way it currently works.

Aren't the police able to recover deleted texts?

Advocate article
quote:

“He raped her, and tried to turn it into roleplay,” the prosecutor said. “This wasn’t roleplay. This wasn’t agreed upon. There was the absence of ‘yes.’ That means there was the presence of ‘no.’”

Gill alleged the woman used handcuffs, whips, blindfolds and other items in the past, and even whispered, “Let’s try something,” into Witz’s ear after telling him her shirt cost only $2.

Remember the Duke Lacrosse players? I could name a ton more but won't.

I do remember that case. It was despicable, but acting like that is the norm is disingenuous.

Studies suggest 51% of rape indictments that go to a full trial result in guilty verdicts, which is in line with similar types of crimes.

The false accusations are a major problem, but using a case that went to a jury is not exactly the poster child for those problems.

Here is a noble idea - how about society learn to let it play out?

Anyone that presents the idea that the accuser should be revealed after a not guilty verdict is being asinine. I don't care if the accused is public or not, but asking victims to subject themselves to more trauma if they fail to present a case that puts someone in jail is absolutely fricking absurd.

How in the world

Police found Witz and before they could read him his Miranda Rights, he told them he was not answering any questions and wanted an attorney.

That's how. Guilty or innocent, cops show up at your door, you're an idiot if you don't do the same thing. Your silence plus a good atty can make ALL the difference.

Not necessarily... lots of variables with how the info was deleted and the model phone. Most exploitation software plays catch up to the latest apple or android on the market.

To be honest I'm surprised they release anyone's name before a conviction. Kind of fricked up when you think about it .
