I am all for trying something different. Prison doesn't reform enough for it to be a finality for non violent offenders. My problem is, most drug dealers do not want to work, do community service or be productive members of their community. I am curious to see how the lack of prosectution for drug dealing affects territories and murder rates.
So are these people still going to be arrested on site? Or are they just going to be written a ticket?

I'm against it because she's subsidizing it, and in the process creating MORE of it. It's basic economics, basic human nature stuff.
Let me give you an example. The city that is probably most infamous for pick pocketing in the world is Barcelona. They get hundreds of thefts of some kind of tourists per day. It's not a matter of if, more a matter of when somebody tries to grab your shite in Barcelona. Do you know what the law says in Barcelona? Any theft of less than 400 Euros can result in a maximum of a 200 dollar fine. And obviously no arrest or criminal exposure. They have de-criminalized theft and as a result they get UNLIMITED theft. Again, if you incentivize something, you get more of it. It's pure folly. Only an ideologue fights the basic laws of human nature and behavior. You guys truly believe you can tinker around the edges of the law and CHANGE human nature. It's just laughable. As proof, let's observe where this goes for Boston.

Violation of Private Nuisance Law
"To prove a case of private nuisance, a plaintiff must prove the following: 1) the defendant improperly created, permitted, or maintained a condition or activity that interfered with the plaintiff’s use and enjoyment of his or her property; 2) the interference was substantial and unreasonable; and 3) the defendant had some kind of interest in the property where the nuisance originated."

"You can ask for a Harassment Prevention Order (a "258E Order) from a judge if you’re suffering from harassment because someone has committed 3 or more acts:
That were willful and malicious. This means it was done on purpose and was done for cruelty, hostility or revenge
Were aimed at you.
Were intended to cause you fear, intimidation, abuse, or damage to property. “Abuse” means causing or attempting to cause physical harm, or causing fear of imminent serious physical harm.
Did in fact cause you fear, intimidation, abuse or damage to property"
Intentional Infliction of Emotional Distress
"a plaintiff must show:
that the defendant intended to inflict emotional distress or that he knew, or should have known, that emotional distress was the likely result of his conduct;
that the defendant’s conduct was extreme and outrageous, beyond all possible bounds of decency, and was utterly intolerable in a civilized community;
that the actions of the defendant were the cause of the plaintiff’s distress; and
that the emotional distress sustained by the plaintiff was severe and of a nature that no reasonable man could be expected to endure it."
That's just three off the top of my head.

You don't seem to understand this term you keep tossing around...much like most in this thread do not understand the difference between pre-trial diversion and decriminalization.
People are still going to get arrested for these crimes. They are still going to have to meet with a city prosecutor. The prosecutor will offer them the traditional jail time/penalties or they will offer them community service probationary programs. 95% of people will choose the latter. By doing so, they remain punished for their crimes but do not bog down the city court systems, nor do they end up crowding expensive jail space for petty crimes.
This is where criminal justice is headed so get used to it.

Even with a 50% non-compliance rate, that's another 50% they were able to keep out of expensive courtrooms and jails.
I'm not saying this is perfect but I do believe it's much better than the status quo and CERTAINLY not worth the cries of "lawlessness" and "anarchy" being bandied about in this thread.

I worked in a small parish prosecutor’s offfice and most of the crimes listed with the exception of drugs were filtered into pre-trial diversion. I have a hard time buying that Boston was not already doing the same. What this is about is declining cases altogether

I am not surprised that you and other Progressives are proponents of Racial Unicornism in our criminal justice system. And I don't expect you to acknowledge it when it becomes a total disaster for the law-abiding people of Boston. Fealty to Progressive Ideology is a kind of license to see the world as the Orthodoxy demands, rather than how it is. And also a license to deny objectively horrible results in favor of spouting Leftist platitudes about "social justice" and "decriminalization". The people of Boston however, will soon be mugged by reality, even as you declare success.
