Blue Dog' art thief walks free after experts say drug overdose caused behavior

An art thief whose attorney admitted he pilfered thousands of dollars worth of artist George Rodrigue's famed "Blue Dog" paintings walked free Thursday after an Orleans Parish Criminal District Court judge ruled that he was not guilty by reason of insanity.
Brandon Powers, a 26-year-old from Metairie, said he had been on a rescue mission to protect Rodrigue's work last year when he heisted a $1,200 limited-edition print of Rodrigue’s “Choo Choo Ch’Boogie" from a Lakeview art shop, according to his lawyer and arrest reports.District Attorney Leon Cannizzaro’s office agreed not to contest the "not guilty" plea after its own mental health expert concurred with Salcedo's assessment.
”He was suffering from a mental disorder," forensic psychiatrist Sarah DeLand said on the stand. "Due to this mental disorder, he was not able to distinguish the difference between right and wrong."
After the matter of legal liability had been settled, Bosworth further allowed Powers to walk free without having to commit to any kind of probation, mental health treatment or hospital stay.LINK

Can a person use this same defense for a DWI?
